Divorced but no Annulment

Wonder what they’ll say when my gf goes home after say 9 months when they were expecting a short return.

but--i considered all the options, and decided annulment was the only safe way to go. its not difficult--just a silly pointless expensive income stream to the Phili legal system.

If the husband divorces her, she can get a copy from him and apply for recognition of divorce (2005 Orbecido III Case) and remarry. This is the easiest route as with annulment, it takes long and it may/may not be granted.

We married in Seychelles. Visa on arrival for both of use. Our wedding certificate was notarized by the closest Philippines Embassy which was Nairobi Kenya. We received the final red ribboned document after about 4 months via DHL.

but is the husband a filipino ? if he could get one, even though he gets a divorce in Canada--i dont think it will be recognised in the Philippines. My filipina wife divorced her Filipino husband here in the UK in 2012, before her student visa expired. It was not recognised in the philis--so she then got an annulment as well. that took 18 months and cost ( me ) £2000.

However--in our case, i think we could have gone ahead and got married using her UK divorce--in another country ( hong kong maybe ). One snag would then be her getting the CFO to leave the philis, plus also she could have risked problems of bigamy.

Another thing to consider with a divorce or annulment--is how will her family / in laws and friends react towards her ? I now know many of my wifes family--and her previous in laws do not know she has divorced / annulled and married me. It makes it a bit difficult for me to accompany her on a visit over there. Difficult as in me never being seen again.

Oh yeah, cannot be done if the husband is a (still) Filipino. I should have asked first. Is he? @Pedro

Further and I think I posted this change if 2 Filipinos are naturalized in another country the divorce would be recognised.

The case you quote is a little dìfferant (Orbecido) in that the man had divorced his first wife the Filipino then remarried, then the Filipino (wife1) raised her want to divorce!

if they are naturalised in a foreign country then they are no longer filipino--arent they ?

It still used to count and the marriage would be on recorded as a Filipino marriage, the change i believe is this, so if the 2 divorced in UK but hubby met another Filipino in the Philippines then he couldn't have the marriage recognised there however now he can as the hubby is ad you say no longer a Filipino

No if the lady is Filipina and hubby American in the past the hubby would have to iniate the divorce now the wife could.

You mean in addition to the route I stated, yes, she can do that.

I do not know what you have read but this is what I have read, "... in the 2005 Orbecido III case, the Supreme Court ruled that although the marriage was between Filipino citizens, if at the time of divorce one of the spouses became a citizen of another country that recognizes divorce, the divorce can still be recognized in the Philippines which will allow the Filipino spouse to remarry..." This is from the Filipinolawgroup website.

What you have posted above is the ruling and outcome and all I am saying is the OPS case is slightly different to the Orbicedo case you quote in as much as one of the partners in the marriage ran off to the States got a divorce and remarried.
So I don't disagree with the outcome of the case as I say the cases are different.
I got it the wrong way round it was the wife not the husband who went off to the states divorced remarried and then her hubby found out see link below.

All a bit dated now as things have moved on with Filipino divorces.

Just noticed on my wives FLR application I have entered the wrong date on one of the questions a typing error should read 2018 when I typed 2019, can this be changed during our appointment with Sopra or put a note in explaining the error, I know when we went to Manila they were able to change things but not sure about U/K, have asked the inquiry help desk but no answer, would hate to have to submit another application and all the costs.

Did you take a hard copy of the application form if so amend the date on the copy photostat the page sign it (both of you ) and hand it in at the biometrics aappointment, if you didnt take a hard copy write it down on a piece of paper not letter form just
