Hi just a quick question.Just got married in the UK on a fiancee visa Am I right in saying my wife can't work until she has been granted FLR M even if she has a NI number. And if you book a biometric appointment and it falls outside the original 6 month fiancee visa closing date that's okay ? Thanks.
she wont get an NI number till she starts her first job..which wont happen till she gets her BRP. ( unless someone else says otherwise )
You can get a job without a BRP or expired BRP by the potential employer using " The right to work web site" this tells the employer if the applicant is allowed to work. You can get a card prior to looking for work indeed it is more helpful to have one.
From memory, my wife applied for - and received - her NINo soon after we were married (on a fiancee visa) and she had received her first FLR(M) Visa/BRP, well before she secured employment.
my wife already had her NI number from her years ( 2008-12 ) on a student visa--which permitted work in those days. Which was her principle reason for coming over here. However the Visa for settlement ( marriage) or " fiancee" visa--does not permit work.
Applied for Ni on line but everywhere she has gone HR have asked for NI plus Brp. Will just have to be patient.
Debating this one? My wife was granted LTR after we married in the Philippines. Her Permit clearly said permission to work from entry. Oddly my step daughter, who was 7 at the time said she was permitted to work also!
An ni number by itself doesn't demonstrate right to work. She'll need a brp to show right to work and an ni number if she doesn't want to overpay tax. You can apply for an ni number with a brp before you start employment but it's very slow - we applied for some for the kids in June and still waiting.
Odd that it says that. Imagine the following situation. An applicant is granted an initial leave to remain. Applies for an NI number. Receives it. Is subsequently denied FLR and hence needs to leave the UK but stays illegally.
