Hi guys I'm wondering if you clear up some confusion for me, as I'm unsure when I can apply for the FLR (M) The confusion lies with some of the forums mentioning I could apply 28 days before expiry of visa And some mention you could apply on the 30th month anniversay ( 30 month anniversary from the issue date of the visa or when she entered the U.K. ????) anyway date of issue : 16-07 - 2020 valid until : 23 -04-2023 entered UK : 10 - 9 - 2020 when is the earliest i can apply? kind regards richard
30th month after arrival would be 10/03/2023 Earliest you can apply is 28 days before that. You’d notice spouse visas issued outside UK are usually valid for 33 months, as opposed to 30 months when issued within UK. At ILR stage, earliest one can apply is 28 days before applicant meets the requirements for time spent in the UK.
its 28 days prior to expiry date of previous visa/brp the spouse validation period is not relevant, this is a constant timeframe (28 days) across the process

the 30th month annivesary seems to confusing and complicated to me. So I will apply within 28 days prior to the expiry of the BRP.
easiest way to remember it is you can apply 28 days prior to te expiry date in most common instances. As a foot note 33 month visas are issued when the applicant is abroad ie a spouse visa 30 month visas are issued when the applicant is in the UK neither removes the 28 day rule.
