Scam Alert: Boracay Luxury Homes (Summit and Dolly Khanna)

    Heads up everyone, this was committed a few years back and is in the courts already but due to the bureaucratic nature of the Philippine courts, the hearings are still not over.

    I am writing this anonymously because these scammers had the gall to sue the complainant with a libel case that the courts didn't even pursue due to lack of merit.

    Vampires in Boracay!

    A DIFFERENT breed of vampires is terrorizing Boracay. They suck on the goodness of the paradise island’s inhabitants and visitors, bleeding them dry. Yet their hunger is insatiable. And they are on the prowl for more prey to sink their fangs on. Victims say they have a name, which serves as a virtual shield from their livid hunters -- the Boracay Luxury Homes, among others.

    A DIFFERENT breed of vampires is terrorizing Boracay. They suck on the goodness of the paradise island’s inhabitants and visitors, bleeding them dry. Yet their hunger is insatiable. And they are on the prowl for more prey to sink their fangs on. Victims say they have a name, which serves as a virtual shield from their livid hunters -- the Boracay Luxury Homes, among others.

    One of the vampire hunters is British geophysicist Jesse Liam Cannon. Cannon, a dual citizen of the United Kingdom of Great Britain, NorthIreland and Australia, instantly fell in love with Boracay when he visited the Philippines in Feb. 2010. “I definitely thought Boracay was the most beautiful place. I saw it as a paradise where I could have a nice relaxing life, set up my home and invest.”

    The exploration and research geologist browsed the Internet and came upon boracayluxuryhomes.com, a website of Boracay Luxury Homes (BLH).

    “BLH offered me condo Unit 304 at Villa Sofia in Fairways & Bluewater Resort in Boracay Islands for P6 million. I was asked to pay a reservation fee of P100,000,” he revealed.

    In April 2010, Cannon formally bought Unit 304. The contract to sell, dated April 15, 2010, was signed by him and Sumit Khanna, BLH director of operations and marketing.

    In June 2010, after paying the down payment and three installments totaling P3,712,360.25, Cannon was told by Sumit that Unit 304 was no longer available and that BLH would just sell him Unit 303. The complainant again signed another contract to sell also dated April 15, 2010.

    In August 2010, Cannon received an email from a certain Raffy Cooper who revealed that Dolora Khanna, BLH CEO, and Sumit Khanna had not been furnishing the unit he had paid for. Cooper also revealed that BLH could not actually sell the subject unit.

    Cooper was a former agent of Dolora and Sumit. He allegedly left the couple as he couldn’t stand how they reportedly verbally abused employees and other people.

    Upon verifying with the Housing and Land Use Regulatory Board, Cannon discovered that BLH does not have a license to sell any condo unit in Villa Sofia at the Fairways and Bluewater Resort in Boracay Island or at the alleged Catalina Building at The Cliff, Boracay Island.

    Cannon later learned that the respondents had been trying to sell to him a non-existent property located at an area in Boracay called The Cliff.

    The Fairways and Bluewater Resort has also stated that it did not issue an authority to sell the units of Sofia Condominium to Dolora and Sumit.

    On Nov. 12, 2010, Cannon filed charges for violation of Section No. 5, in relation to Section No. 39, of Presidential Decree No. 957 against BLH officials Dolora “Dolly” C. Khanna, CEO; Sumit Khana, director of operations and marketing; Rochelle Fender, director of international sales; Darrel Girdner, general manager; Joseph Rose, director of finance; Rex Carlson, director of finance; and Julie Rose, marketing and business development consultant.

    The case was filed before the Department of Justice which found probable cause against the Khannas for violating P.D. No. 957 and the Revised Penal Code.

    More victims surface

    Months after People’s Tonight published Cannon’s story, one of the Khannas went to Philippine Journalists’ editor-in-chief Augusto B. Villanueva, requesting that the article be deleted from the PJI’s website.

    Mr. Khanna claimed that he was making the request as the company’s lawyers were already talking with Cannon and his counsels.

    Cannon’s camp and one of his counsels, Atty. Ian Ludovice, denied that they had been settling the matter with the Khannas nor their lawyers.

    In a statement, Cannon revealed that the Khannas have not paid him a single cent.

    “They still think that the laws of fairness do not apply to them. They think that they are exempt from the consequences of their actions but they are wrong. More than ever, I am committed to bringing them to justice and I want them to feel the full force of repercussions for the terrible things that they did to so many people,” stressed Cannon.

    Meanwhile, other foreigners have surfaced and filed cases against the Khannas on the same grounds. Like Cannon, the Boracay Luxury Homes allegedly sold them properties illegally for millions of pesos.

    According to Atty. Ludovice, Tyler Anderson and Peter Eckert, both Canadians, paid more than P20 million to the Khannas for property which they never got.

    Anderson and Eckert were also allegedly lured into buying real estate property in Boracay after seeing the ads of Boracay Luxury Homes.

    Again, like Cannon, they eventually found out that the Khannas have no authority to sell as real estate developers.

    The HLURB has issued a certificate stating that Boracay Luxury Homes and the Khannas are not licensed by their office. The Securities and Exchange Commission also has confirmed that Boracay Luxury Homes is not registered with it.

    The Department of Justice has also found probable cause against the Khannas for the case filed by Anderson and Eckert. The court has already issued a hold departure order against the Khannas.

    Cannon has vowed to continue his fight until he gets justice and recovers his hard-earned money. His full statement reads:

    “We tried reasoning with these people, but they still think that the laws of fairness do not apply to them. They think that they are exempt from the consequences of their actions but they are wrong. More than ever, we are committed to bringing them to justice and we want them to feel the full force of repercussions for the terrible things that they did to so many people.

    “The Khannas better wake up fast, their other victims may be seeking a hassle-free retirement, but I am a young man who is deeply loyal to this fight for justice. I will fight.

    “The upsetting and troubling fact is that their fraudulent scheme is still in operation! Time is the key and I want the authorities to know the importance of swift action. If we don’t act now, more foreigners are going to fall into their trap and have their lives ruined here in the Philippines, this is not an acceptable image for this beautiful country.

    “The court process is formally begun now and it is our chance to take the actions that are right and true. We are many innocent victims and now we are calling to the authorities to recognize our obvious evidence. The Khannas think that they can twist and con the system, while good people work hard just to put food on their table. It’s time to teach them a lesson.”

    People’s Tonight gives good impression of PH media

    Cannon expressed his deepest thanks to People’s Tonight for helping him in his fight against the Khannas.

    The British geophysicist said that his impression of Philippine media has been good due to People’s Tonight, adding that he will urge fellowmen in Britain and other foreigners to also have the same positive outlook.

    “I hope that People’s Tonight will also publish my deepest thanks towards them. Due to them, my impression of the Filipino media is a very good one. Every Filipino that I have met with has actually supported us,” Cannon said.
