How to get filipino citizenship if i am married to a filipina

    Sorry if im innocent lol, we just dont know where to start and how to start, feels like i want to get an agent to sort it out for us, my husband wants to be permanent resident in the philippines without losing his rights in the uk, so if we get the 9a first then keep extending it until we have all the documents for 13a visa? Is that right?

    So he doesnt need to apply for 9a visa? If he is eligible for privileged?

    Balikbayan privilege is available to the spouse of a Filipino citizen when they return together to the Philippines it is a stamp put in the spouses passport which allows a one year stay without any visa but you have to enter together and you should have your marriage certificate with you to show to immigration.

    @cheng I think the first thing to do is tackle the issue from 2 sides and try not to bounce around.
    Side 1 is your Hubby moving from the UK if I was in your shoes and his I would work through what it means to him both short and long term.
    Have a look at this link the UK gov site will cover all potential situations.
    As @oss has suggested read the links carefully make notes and questions against each point. Look to resolve or the very least understand each situation.
    Then do the same with moving into the Philippines from the Philippines gov site.
    I am not a great believer in looking at what others did (although they can give pointers are they the right pointers) as all cases are unique, spend time on your own situation.

    The entry of all foreign nationals shall be subject to the following conditions:

    • All arriving travellers must undergo 14 days of quarantine on arrival, unless they have been fully vaccinated in the Philippines, where a 7 day quarantine will apply. For those who are not fully vaccinated, the first 10 days of quarantine must be pre-booked in an accredited quarantine hotel/facility. The final 4 days can be completed under home quarantine at their destination (subject to COVID-19 testing at the quarantine hotel/facility on the seventh day from date of arrival).
    You are considered fully vaccinated two or more weeks after receiving the second dose in a 2-dose series, or two or more weeks after receiving a single-dose vaccine. A fully vaccinated individual must verify their vaccination certificate prior to departure, and must present it to a Bureau of Quarantine (BOQ) representative for re-verification at the Department of Transportation (DOTr) One-Stop Shop upon arrival in the Philippines. See ‘Demonstrating your COVID-19 vaccination status’

    The pre-booked accommodation in a quarantine hotel accredited by the Department of Tourism shall be presented for initial check at the immigration counters. Those who fail to present proof of pre-booked accommodation shall be denied entry and risk being boarded immediately on the next return flight.

    Guys need some advice, coz my husband is planning to lumpsum his pension, and he will need to pay 40% tax.. Why does he ne3ds to pay tax if hes going to philippines and spend his life over there..?

    Absolute insanity, nobody in their right mind would try to take 100% of their pension in one go, that is totally insane.

    Yes he has to pay the tax because pensions are taxable when you take the money from the pension and he takes the money from his pension while he is in the UK so it is UK earnings.

    Really you need professional advice, your husband seems to be trying to make a lot of very dangerous life choices and decisions without any understanding of the implications.

    If you don't mind me asking how much is his pension fund worth, just approximately, if he is going to pay 40% tax on any part of it then his total pot is worth more than £62,500

    He should be looking at a drawdown plan and taking 25% of the entire fund tax free.

    For example

    £200,000 pension fund

    £50,000 is allowed to be taken completely free of tax

    £150,000 left

    If he takes all of that as a lumpsum in a tax year where he has no other earnings he will pay about

    £55,000 in tax (£150,000 -£12,500 personal tax allowance times 40%)

    and be left with

    £95,000

    so £200,000 becomes £145,000 after he has paid tax.

    So that's not going to last very long in the Philippines.

    You both need professional advice seriously.

    If his pension pot is a lot bigger than that guess of £200,000 then he is going to pay even more tax as the top rate is higher than 40%.

    @oss he's planning to stay in the philippines for good and not to come back in the uk, if he didnt take all the lumpsum can he still get it even if hes the philippines?

    Yes he can make drawdown requests and have money paid into an account in the UK while leaving the drawdown capital invested and earning interest.

    This is the kind of stuff that needs professional advice if he has more than £100,000 in his pension then he needs to take advice because losing all that money to tax is just dumb incredibly dumb.

    What sort of age is he, how old?

    @oss hi yeah, after finding out they will charge him 40% he changed his mind not to take everything.. @oss so for now we dont need to apply any visa for him? We just need to travel together and show marriage cert. To BI then they will stamp his passport for 1 yr stay. Is it right?

    Yes that is correct, however at this time if you were to return you will have to arrange a stay in a quarantine hotel and Covid tests for both of you according to current travel rules as Mattecube posted in post #28

    These rules apply because you were not vaccinated in the Philippines but in the UK, the Philippines does not currently appear to accept vaccine documentation from other countries.

    @oss hello i tried to contact the embassy in london many times and the line is always busy i dont think they are receiving calls anymore, regarding the 9a visa is only valid for 59 days isnt? Its better i can use my balikbayan privileges but the thing is if they are still accepting it or if is still valid to get my balikbayan privileges.. In 2018 we travelled together and they were looking for our marriage cert. And i didnt have it.. Then thw IO told me ok i will stamp 28 days only..

    if i were in your situation--i would stay put here in the UK till this covid pandemic is sorted out over there.
