Need advice about going back to uk

    Hi guys me and husband are both staying in the philippines now since september, just before we leave the uk i was about to apply my ILR but unfortunately we decided to go back to philippines.. Then now we are thinking to go back to uk, since the restriction over there has dropped.. My question is, what can we do to go back there? Can i apply for ILR outside the uk? Can i still be eligible as i am married to british citizen?

    when was your FLR(m) valid till?
    Also you need to calculate if you have broken this rule
    180 days

    Many UK immigration categories impose a requirement that the visa holder must not be outside the UK for more than 180 days in any 12-month period — that is, if the person wants to apply for indefinite leave to remain

    14th of september 2021 and i left on 4th of september..

    I think that you will have to start the whole process again, I dont believe that you could use the pandemic as an argument for letting your visa run out and leaving the UK,.

    U mean i can apply for spouse visa again? But the problem is, my husband got retired.. And we used his pension money to pay off our house in the philippines.. So we have nothing to worry of losing our house when we moved back here in the philippines, do u think i can apply in the uk instead of applying in british embassy in the philippines?

    As I understand it you will have to start the spouse visa again, you are going to have to apply from the Philippines.
    You will have to demonstrate as before you have somewhere to live in the UK and that your husband can meet the financial requirements of the spouse dependent visa.

    We might have a problem to pass the financial requirement as he already retired... What about human rights? As he is a british citizen?

    He can return as a British Citizen but you will need a visa!
    You would of been far better off as I am sure you are now both aware to of got your ILR and then gone to the Philippines.
