2nd spouse/ settlement application

    Hello

    Timeline of my spouse application dated 14 04 2017. No help with solicitor.

    Date of application 14 04 2017
    Biometrics date 20 04 2017
    Vfs manila, determined @ sheffield UK.
    Received " NOT STRAIGHTFORWARD" email 14 07 2017 day 60 from biometrics.

    Countless efforts we made to find out what was going on....with the help of our MP but to no avail.

    Fast forward to day 124.
    Received email for passport collection 13 10 2017
    Received passport 16 10 2017

    Visa: refused

    Reasons of refusal:

    1. Financial requirements not met

    due to a supposed bank statement doesn't match 2 current wage slips.
    Note : my husband's annual salary exceeds the minimum requirement.

    2. English language certificate
    that had been registered as for education rather than visa purposes.

    Note : used an academic ielts. My fault.

    ECO not satisfied.

    2nd application made soon after we updated our documents and provided an up-to-date bank statement and the correct english test which is A1 life skills ielts test.
    * With solicitor's help
    We were advice to 're apply .

    Timeline

    Date of application 25 11 2017
    Biometrics date 01 12 2017
    Projected timeline given 12 weeks
    Confirmation email from UKVI 05 12 2017
    Documents delivered back to UK address 19 01 2018

    My husband went home here in Philippines for 3 weeks holiday December 2017.

    Day 57 received "NOT STRAIGHTFORWARD" email ....again for the second time. 23 02 2018.

    I feel lost and emotionally drained at this point of our application.
    In tears whilst typing
    we are assured by our solicitor that the Home Office would have no grounds to refuse the application. As such, the application should be straightforward to process and determine. I do not know what else to think as why is this happening again, if it will be refusal , if the HO will give us silent treatment like last year and wait for 6 months just to find out the decision.
    Day 60 is still not till the end of February.
    Is there any delays currently for settlement application?

    Any advice or help will do and appreciated . As i am at my wits end thinking what's going.

    Hi , sorry for what happened.. But may I ask, did you use your Academic IELTs test on you first successful spouse visa application or this is your first spouse visa?

    Hello @jasmine16 this is my first settlement : wife application.
    Although on a second application as my first was refused, due to refusal reasons i stated above.
    I used academic on my first application rather than A1. We corrected the reasons for refusal. One of which is the ielts

    We do not know if the 2nd application will get refuse. As we rectified the reasons for refusal on the 1st application. As of now no update yet. My husband called the HO call centre and the response. Was " still awaiting for decision. "

    @MrsDoyle what type of IELTS test did you took? I heard from some forum members that they used IELTS for UKVI-academic when they applied for a spouse visa and got the visa.

    I used academic Cambridge, on my first application last year april, problem is as stated on the letter i didn't indicate the purpose of the test to be for visa purposes. And I should have took the A1.

    Oh I see. This application was your first 2.5 years of spouse visa? and it was refused twice because you used the Academic Ielts?

    I heard and read something like this too if that Academic Ielts was used on their previous SUCCESSFUL APPLICATION. I guess @Mrs Doyle was applying for her first 2.5 years of spouse visa and she applied twice but refused? Am I correct?

    Yes, it is my first 2.5 years application.
    No, i just got refused once, the first application last april 14 2017.
    're apply last November 2017, haven't got my decision yet. We are still waiting for the decision to come through. We only got the not straightforward email on the 57th working day last February .

    Yes, I have also heard that some got a successful results with them providing the academic ielts. I just do not know what was the ECO THINKING! been in the uk for 7 years and had my masters there too. Submitted that info/ documents. But still ECO NOT SATISFIED.

    I think if it's your first 2.5 years spouse visa you need A1 exam.
