After marriage in the Philippines how long does it take to get the settlement visa?

    Larry, so we have gone from getting married in June in Phills, to getting married in Phills, and now back to getting married in Spain late in the year, I take it that you mean this year ?. I'm guessing that this is because your Fiancée has this problem of the overstaying in Spain, and once she has left Spain she won't be able to re-enter. Larry you hold all the cards in this arrangement, if both of you can't reach an amicable solution before your marriage, without open warfare as you call it, what chance after ?. I suggest you really need to consider where this relationship is, and where it's going.. I say this as a friend who is concerned where it's heading.

    On the date of the wedding?, on the wedding taking place?, and if it does on how long it will last ?, I suggest an odds book on all three.

    What documents do I need to take with me to get the settlement visa ? And were do I go to get one? I'm a uk Citizen going to marry a filipino in feb, please help as I have know idea what to do many thanks

    From previous posts believe you are both planning on settling in the UK and marrying in philippines in February.

    As such the answers are probably not what you are expecting to hear or want to hear. The option that you willing be looking at is the spouse visa route with a five year path to British citizenship.

    First thing to be aware of is that cannot submit visa application until you are married as one of key documents will be the marriage certificate.

    You will need a number of supporting documents which fall into the following categories:

    Proof of relationship - marriage certificate, evidence of meeting and communications between you
    Financial situation - evidence that you can support both her and yourself without recourse to public funds - either salary of 18,600 or savings of approximately 62,500 or mixture of the two. Will require at least six months of bank statements, payslips etc
    Accomodation - evidence of somewhere for both of you to live which does not result in overcrowding.
    TB Certificate - from specific medical centre in manilla
    Proof of english language - specific test from specified test centres

    There are a number of posts on here where people have listed the evidence they submitted as part of application - including myself which will give you more detailed lists.

    Need to start gathering information now to underpin the application

    Once submitted the application will take about three months to be processed. This will give her a visa good for 33 months with a requirement to be in UK within 30 days of the start date of the visa.

    You then have to apply for a furthur visa after than yo get her to five years at which point she can apply for indefinite leave to remain and once that is granted she can apply for citizenship.

    The costs are significant for each visa application. First one will be about 1600 pounds for visa and another 1200 pounds for the IHS charge. Second will be about 1000 for visa and 1200 for IHS charge and ILR will be about 2400. Can't remember cost of citizenship application but think similar to visa costs.

    Will also be requirements for additional English language tests for future visa applications and life in uk test.

    She will also need CFO certificate to leave the Philippines do need to plan for that - specific requirement of philippines government. Can't leave the country without it. The statement might
    Will not be quick, easy or cheap but hopefully worth it in the end.

    Best of luck. So long as research what needs to be done, meet evidence requirements then should achieve the spouse visa.

    when you are married unfortunatly you are going to have to leave your new wife in the Philippines while you return back to the UK unless you are planning an extended holiday for yourself over there
    Once married rough timescale and application path will be as follows
    wait for return of marriage certificate (PSO) allow 6 to 8 weeks
    once you have this you can progress the spouse visa application for your wife
    There are things your wife can do in the meantime while waiting
    English test (at approved testing centre) allow £200 cost approx she will need to evidence passing A1 or above.
    TB screening (at approved centre) allow £60 cost approx she will have to provide the pass certificate.
    You can start now gathering information to support her application as you will be her sponsor.
    You will need t evidence proof of earnings minimum £18600 per year or savings (6 months payslips prior to the application) or savings of £62000 held in your bank account for 6 months prior to the application date or a mixture of both (there is a calculation for both and best left till nearer the time if you are going to use the mix)
    You can gather evidence of a place to live for you both.
    Nearer the time when you are ready to apply a letter from your employer stating your employment status is required.
    you will make an electronic application and there will be a requirement to have documents scanned into their system (this can be explained neare the time when you are ready.
    Visa application cost will be £1550 approx at current value and £1200 NH Surcharge both these to be paid at application stage
    Once application is in you will wait for a decision of between 6 and 12 weeks approx depending on the strength and complexity of her application.
    She will need to attend a CFO seminar prior to leaving without attendance and certificate she will not be permitted to leave the country
    Once you have a positive decision she will be given a travel vignette valid for 30 days she must travel within the dates
    Once in the UK she will be issued a BRP (British Residence Permit ) card this will have a valid from and to date on and will be approx 33 months duration
    You will then be applying for her second period of Leave to remain (nearer the time again this can be picked up with you)
    Headline costs to get your wife here and a British citizen
    Spouse visa £1550
    NHS surcharge £1200
    English test £200
    TB test £60

    Second set of costs for 2nd period of Leave to remain
    Visa cost £1033
    NHS surcharge £1000 (as she is in UK)
    English test £200

    ILR and British citizen costs approx £2400 and ?£1200

    So approx £10000 at current rates

    you really need to research the whole thing with regards to a settlement-spouse visa. start an account on here https://www.visa4uk.fco.gov.uk/home/welcome
    and have a practice run through to get the feel of it. you can save / change/amend / scrap the lot and start again / till you feel confident with it. feel free to ask questions as you go.
