Anyone Know About Land Title Things Here?

    Long story short:

    Wife's Father died about 12 years ago always saying he had lots of land...

    One of the family has finally found something... We've all gone to have a look at it, paid the tax that was outstanding and got the surveyor in to measure it up.

    Subsequently received a summons from the Barangay Captain telling us the land... is actually owned by someone else... had a little meeting - The new "owner" has given us a piece of paper TCT Transfer Certificate of Title - telling us some kind of story which I think goes "the land was mortgaged to somoeone and she bought it off the person who held the mortgage..."

    Family say it's bollox as the Grandmother was very rich and therefore wouldn't have mortgaged it etc.

    I know very little about this sort of thing... anyone want to have a look at the TCT and tell me what it means?

    I would be wondering why the so called new owner has not paid the outstanding taxes, and is the so called new owner well in with the Barangay Captain ?.

    Barangay captains are a waste of space, at least mine is. Better to get an attorney to have a look.

    I know one who is on the take, corrupt to the core, her son was taking shabu but he never seemed to be shot or arrested.

    Hehe... you're all right - he partially owns the land behind is collecting a rent on "our" land from the LGU!

    I actually looked there Jim... trouble is we only have an electronic copy not the original... general consensus we need to ask a lawyer next - meeting with the Barangay Captain obviously not very useful given his interest.

    My experience in buying a land is - a tax receipt on a land is a heavier proof of ownership than just a TCT. This is because, they check ownership before they let you pay the tax declaration. You can verify this info from Taguig City Surveyor's office as it is where I got it whilst processing the transfer of Tax Declaration to my name. Holding a TCT alone under the name of another is not a proof of mortgage or ownership. It needs to come with a Notarized Deed of Sale and other papers like previous year's tax declaration, blueprint etc. Without the other requirements, one may be sued. You should have been advised to have a notarised loss TCT right after paying the tax & before getting a surveyor because news travel fast, greedy snakes, faster :D

    How do you know a TCT is NOT fake? visit the city's surveyor's office and have it checked. I can compare it with mine if you want BUT never ever send electronic copies without writing a cross over a copy and adding some notes like 'For Enquiry ONLY' or something like that.

    There is a long list of requirement in order for one to transfer tax under a name. Some original/s required. I can dig into my file if it helps else you can just send someone to get you the list from any government surveyor's office. It is the same list that will show a buyer/family member if the title is clean.

    Less talk with the Barangay Captain, the better as this issue is beyond his position (I think). I would never disagree directly with any government official.

    I just noticed your post was more than a month's old :D. I hope it has been settled. Not deleting the above just incase...
