Applying for a Child (Dependent Visa)

    i mean--when a filipina divorces her filipino spouse while shes in the UK--like my ( now ) wife did.

    there must be others--filipinas here on working visas--who have--or intend to--file for divorce here.

    i wonder if someone here on a visit visa could ?

    By the way, when applying for dependent child visa, is it really a must to submit tenancy agreement?

    As with spouse visa there is a requirement to demonstrate that there is adequate accomodation available for the family. So need evidence that accomodation exists (tenancy agreement), that there is permission for the applicant to live there and that it will not be overcrowded - hopefully tenancy agreement provides details of accomodation in terms of rooms - if not may want to consider property inspection report to confirm that.

    There are specific requirements for how many rooms are required but if have two rooms or more ( bedroom and living room or another bedroom then should be fine on that.

    Hello! Quick question. For the accommodation, will they allow a prospective landlord?

    We are living in a 1 BR flat now (no living room). Since we are already about to apply for a dependent visa for my child, we plan to move to my cousin's house by the time my daughter is here. Or a month from now.

    Can I submit a letter from my cousin stating that we will live there in November 2020, without any objection that my child is also staying there, plus a contract?

    Is your cousin the owner of the house? Does the accomadation meet the requirements so as not be overcrowded. Have you seen the rules on adequate accomadation?

    Hello!

    Yes my cousin and her husband are the owners of the 3BR house. Yes, the accommodation also meets the requirements according to the rules on AA.

    Do you think a letter from her will suffice that we will live there by the time my daughter comes?

    I would think so I would photograph every room in the house to show the rooms also include her council tax demand I think it shows on there the number of bedrooms( not sure though)
    When are you applying and I take it your in rented now?

    Hi all. I am following this topic and I have had successful adoption in Wales last April 2021 ( adoption through step parents , my husband is British national and I am a filipino under Spouse visa ) . We applied the British passport but application was return to us due to child's name is not the same on Philippine passport and the adoption certificate. How will we start to change it to PSA as we dont have the capacity to travel this year? also, limited websites and FAQs in Philippine government website. The last quotation we had from a Filipino solicitor is whooping £8000! Please any help? Any advice is highly appreciated

    Always seems to be a problem and had the same fun getting the British passports. Wife through other groups has heard of people failing to get passports. We got both of them so it is possible to get them although they insist on including the details of the Philippines passport on the information page of the British passport.

    You need something from Philippines Embassy to say not possible to change the kids names on the Philippines passport.

    I'm not impressed with HMPO on this one as this is not the first time they have had this and doubt it will be the last (they are part of home office so maybe should not be surprised that they like to do this). The email or letter that you got back should have had something in it that said you need confirmation that the name can't be changed and suggest you go with that line. Email the Philippines Embassy and detail the problem and say that you need confirmation from them that not possible to change the name. We got the response below which we used with HMPO to get the passports. Take the line with HMPO that not possible to change names and use the info from the Embassy to justify it. Can go pay the £23 and get the certificate from the Embassy and use that.

    I found the Embassy were quite helpful and responded quite quickly.

    Depending on whether the new name conforms to Philippines naming convention then may be able to change it and also may not be possible as naming convention is set in law. Process is as detailed below to get it done and it will be a painful process and take years. Similar to getting an overseas divorce recognised. Expect at least 1 to 2 years at least to get the court order and then another year getting the local registrar office to inform the PSA and get a new PSA birth certificate.

    "Regarding your query on name change, please be informed that pursuant to the revised Rules of Court of the Philippines, any decree or judgment of a foreign court, such as the Adoption Order issued by the UK Family Court, cannot be accepted unless it is submitted to a Regional Trial Court in the Philippines for judicial recognition. A name change may be effected once the Philippine Court issues an Order recognizing the adoption, which will be submitted to the Philippines Statistics Authority (PSA) to reflect the name change done on adoption. As such, unless a PSA-issued annotated birth certificate is provided, the name of the child cannot be changed on Philippine passport.
    You may wish to apply for a Certification to this effect which you can present to the British Authorities should they need or require a supporting document for your child's passport application. You may be asked to submit the Adoption Decree, PSA Birth Certificate and Philippine Passport of the child. For the application form and requirements, please visit the link below:
