Can't find record of his Philippine marriage

    you will need to employ a solicitor who will obtain an injunction.

    You go to a Judge with your solicitor and ask for the children to be made 'wards of court' ... and not permitted to be taken out of the country.

    (I did this when married to my Filipina ex).

    I suspect that the Filipina ex is threatening to remove the children (who presumably were born in the UK and are British) as a tactic; I agree with Graham that an application for them to be made wards of Court is the best way to go.

    Thank you! Sorry for the late reply. We have seen a solicitor now and she can't leave or move without his permission, if she tries we can have her arrested and the children removed from her care.
    We also applied for cenomar in his name, it came as AOM saying they are married. The e-census still state they can't issue the second marriage certificate though as there's no court record of nullity attached to the first marriage cert.
    I'm now extremely confused. We can't apply for uk divorce without the original marriage cert and the philis has basically said she's married to her first husband and my partner. We have applied for a cenomar in just her name now and are currently waiting for delivery.
    Does anyone have any advice on what we should do next please?
    Is there anyway of getting e-census to issue the second marriage certificate?

    You're not the only one that's confused. You're saying the Philippines records say that she is married to two people?

    We applied for the second marriage certificate, they sent us the first one saying it's still presumed valid so we applied for cenomar but that says they are married, e-census won't issue the second marriage certificate
    From the emails we've had it does look that way

    Hi everyone
    After months of searching for help (thank you to those people who gave advice!!) and waiting on certificates so my partner can apply for divorce, We have discovered my partners marriage to his Filipina ex IS bigamous.
    We can't get his marriage certificate from ecensus so we attempted to use the AOM certificate for the divorce. The petition was returned (as expected) saying the court needs a letter from Philippine government saying they can't issue the marriage certificate with her name on, then they can issue the divorce petition. Does anyone know how or where we could get that please?
    Other than that our Philippine legal advise said we need someone in the philis to get the certificate from NSO and send it to us, we don't know anyone out there who could help do that and a PI would charge between $200-$1000 to do it.
    We can't ask his ex for help with it because she thinks I have made up my own laws and that we are making up lies.
    I know that we can just apply for annulment in Philippines on grounds of bigamy and then she won't be able to go home without going to prison but we don't want to do that because of the children, as much as he is angry he knows the kids need their mum.
    My partner just wants a uk divorce which is simple, quick and free for him due to our financial situation and as a British man that's all he needs.
    Any help or advice is greatly appreciated!

    I know little of this subject, but isnt a bigamous marriage void from the outset - no marriage ever existed?

    Yes that's true but unfortunately it still needs to either go through Philippine court for absolute nullity or get a uk divorce

    Hi All,
    Foreign Divorce is recognized here in the Philippines, only if you are a Foreign Citizen of that country and you must have the certified copy of the Divorce Order, duly signed by the Judge or Clerk of Court who issued the order.     Hello all, I thought I'd come back to update you all on how things have gone the last year.
    First of all I would like to thank everyone who has helped and given advice, has been a great help!
    Turned out that as his marriage was not legal in the country it was solemnised, it wasn't legal here in the U.K. But to avoid any issues we did apply for a U.K. Divorce. We had to use the AOM and the email from e-census to have the divorce petition issued. Then as she refused to sign it, we had her served by a court bailiff. Even though she tried to be as difficult as possible, she was unable to stop the divorce. Tomorrow we will receive the decree absolute.
    Now the issue with the philipines is her problem. She now has 2 issues to sort out there.
    If she attempts to go home now she will be stopped this end if she attempts to take the children. She can go If she goes without them but then there's a great chance she will go to jail when she arrives in philipines.
