Child settlement visa application form Philippines to UK

    Anyone can give me guidance in applying a visa for my two boys. Eldest will be 18 in September and the youngest is 14 years old.
    I’m in the process of gathering the documents.
    My spouse is my sponsor and will be the sponsor of my children.

    You need to get your application in before your eldest turns 18 otherwise she wont be a dependant

    Yeah I’m looking to make an application by 2nd week of August.
    But I’ve been looking on the refusal on the grounds of sole responsibility. And it seems I need to have more evidence.

    is the boys father on their birth certificate--is he alive ?

    Yes the father is on the birth certificate. But they are under their grandmothers care-My mom.
    My mom have a certificate of relinquishing responsibility because of her being ailing already so she is giving back to me the care of my children.

    be aware you need to prove you have sole responsibility for your children. not easy. several on this site--us included--have been refused child visas.

    Indeed... that’s why I’m trying to read and gather more information on what other documents I need to include in the application

    I just got my spouse visa last month and my husband is British and will be sponsoring my children as well

    I came on a fiancée visa and got married here in the UK and got the spouse visa last month

    in my experience--your problem will be the childrens father--being on the birth certificate--and their ages. UKVI look for any reason to refuse if they think he is still involved in their lives.

    i would suggest you seek expert advice from a UK immigration lawyer.

    I see from your other post you have been in the UK for 10 years before going back to the Philippines and then coming bavk here.
    Given that history I think you are going to struggle convincing the UK visa people that you have been responsible for the bringing up of your children.
    As has been said you need to consult an immigration lawyer and fast,time and your residential history is ahainst you.

    Right now my wife and I are working on this very similar matter, where we need to show sole responsibility to her daughter. We are currently half way through cour proceedings where she will get documents from the court showing that (super lucky her cousin is a Ilocos Norte lawyer). After that we will apply but its going to be around the 4 month mark before its finalised (October). I hope you can get the evidence you need.

    Does it have to be a document from the court to show the custody?
    Can a mere affidavit relinquishing custody from the guardian ( my mom) be enough?
    Or if the father will be able to provide same affidavit would that suffice?

    When I spoke to her cousin, he recommended the document, but I read somewhere on the forum that one member got it with an affidavit. You are against time, it might be the best option for you. Good luck.

    the very fact that the kids father is on the birth certificate and is still alive will be taken that he has joint--or in your case--sole responsibility. its up to you to prove he has no responsibility. good luck with that.

    Hello there,

    @bigmac is correct if the father is alive then its assumed he plays some part part in the child's life.. I was told by my Immigration lawyer that even if the father provides written consent for his child to live in the UK, this is detrimental.. as is proves the father is still making decisions about his child...
    If the the fathers whereabouts is known I believe a Court order claiming sole responsibility... If Unknown a affidavit stating how long you have been apart and that you pay all cost for your child and letters from school, doctors, dentists, priests, reciepts etc..
