Daughter refused UK Passport

    Hi All,

    My daughter is in Philippines and she was refused her British passport because my partner was married at the time of the birth to past partner (now waiting annulment final documents which is now complete).

    We will marry ASAP and I will apply for my daughters British passport again. I am registered as her Father on Birth Certificate. Is there any guidance on maybe anything I could submit to stop this being rejected again and will it be better if we are married before I apply?

    Looks like there is case law to support your position and a work around at moment although expensive as have to go down registration route. Based on article there is expected to be law changes shortly although that doesn't help in the short term.

    Not expert enough on annulment law to know whether it will solve your problem but suspect not.

    Hi BR,

    I have took the route of annulment for my partner, which was deemed by the court an illegal marriage. This I am told will wipe the record of my partner being married during the time of the birth, thus it will not be recorded on the cemonar.

    I will marry and then apply again for my child's UK passport. Would there be anything else to add. I have discussed this with UK passport office and they stated this "should" help the application. Any views or guidance welcomed.

    The link appears to only cover Children born in the UK or overseas territories of the UK.
    UK gov recognise the law of the Philippines at present.
    I agree with whatt the OP is being told by the passport office.

    Glad you agree with passport office as it has been a long wait for annulment and my family are pushed to the limits being apart. Thanks again.
