Divorce rules in the PH please

    • I was married to a Filipina in the UK and divorced in the UK, however as my ex needed to renew her passport and use her new married name our marriage was recorded and recognised in the PH.
    • Now we have been divorced a few years and i want to marry my fiance in the PH, my question is what do I need to do to obtain a clear cni in the PH. I know what i need to do in the UK but the Ph issue is boggling my mind!

    This is tricky most of the questions are usually from the Filipino side, from your ex's perspective she needs to have her divorce recognised in the Philippines in order to remarry in the Philippines, that requires a court hearing and then registration of the relevant documents with the NSO although I think the name of that organisation has now changed, the procedure is simple and administrative but costs money.

    You as far as I know are free as you are not bound by Philippine law as you are not a Filipino, but I am not 100% sure about this, to marry again you would just have to be able to show relevant divorce papers, I think, to prove that you were not married, others here may have a better perspective on this.

    Well thank you and that would be awesome if that is the case!. The NSO is now the PSA I believe.

    Yeah it's the PSA I always forget, I had to get my kids birth certificates from them last year.

    edit: as I said I don't know for sure so you need to do a bit more research but I think that you would only need to show no impediment to marriage under the laws of the UK.

    Your ex will need to,
    You will still need to register the court decision recognizing your foreign divorce with the Philippine Statistics Authority (formerly National Statistics Office) before your marriage record will reflect the divorce. This results in an Advisory on Marriage which notes the divorce and allows you to remarry. This process can itself take months.

    Although the advisory on Marriage may only reflect your exs name so she can remarry, it may also contain your name so if you want to remarry the advisory will be needed.
    Otherwise when you put in your cenomer to marry before the advisory on marriage is issued you may get turned down

    I would suggest you attend the British embassy and apply for an avdavid to marry and just see what the embassy say. Worst case scenario is they point you in the right direction.

    One thing you will need is an original decree absolute of your divorce. I went to the embassy with a printed copy and they refused to accept this. It then took some time to obtain an original and have it airmailed to philippines.

    I am divorced to a British woman so I know this is different but all I needed was the afidavid to say I was free to marry. You may well need to register your divorce as mattecube suggests but it's worth a trip to the embassy.

    If you are now living in the UK it would be far easier to get married here.
