Does my wife need a new Philippine passport to apply for ILR in uk or will expired one be ok ?

    My wife is coming up to applying for the indefinite leave to remain. He Philippine passport expires in July and the ILR application will be going in in December ...

    Does she need to renew the Philippine passport now to get the UK ILR? or can we use the expired passport as id then apply for her Philippine passport later ?

    i dont know the answer--but if i were in your shoes i would get her passport renewed first--to be on the safe side. you dont want to jeopardise her ILR application--and the whopping great fee----on a technicality

    Thanks - We were trying that BUT - they rejected her in the embassy - they say her paperwork is NSO and its should be PSA - so now we are awaiting new paperwork to eventually arrive so we can have another go .. plus the old passport wasn't in good condition cause of a 15 foot wave of water in 2013 that soaked it ...

    Oh one last question .... does anyone know if the Philippines sends back the old passport when you get a new one? its got the original visa in it. ( want to use it to support the ILR application later )

    The ILR 'visa' is stamped into her Passport which obviously must be valid at the time the 'visa' is issued.

    Not always. My wife recently obtained her new Passport (through the Rome Embassy) and her previous one was not returned. However when her old one was issued five years ago, her then expired current Passport was returned. to her. I suggest you get (at least one) certified copy made by your Solicitor.

    The ILR isn’t actually stamped in the passport as your are given a BRP card but you need a valid passport to apply.

    You don’t need her original visa as that too would have been replaced with a BRP at FLR stage. When she applies they will be fully aware of who she is and what visa stage she is at, the original visa has no relevance as evidence at ILR stage.

    It’s changed lots even since mid 2012 until now.

    The financial requirement, the increased visa time period, additional visa’s required over that increased time period, varying levels of English requirement, SELT, changes in supply of the accredited English test centres, introduction of TB test, obligatory visa price increases and BRP replacing the paper visa in the passport.

    No doubt I’ve missed stuff but yes constant changes. The things we do for love... well when we meet someone beyond the EU anyhow!
