Does my wife need an English Test?

    I just got married with my Filipina wife lately in the Philippines. Now, I'm back in London and I am preparing for the visa application of my wife.
    I get cofused with the link I read about the requirement of applicants taking an English Test. It says there that an applicant will need to meet the requirement if they are: a national of a country outside EEA and an applicant applying as a wife of a person settled in UK. But it says also that the new english requirement does not apply to the applicants like: the spouse of an EEA national.
    Can anyone help me explain about this? Thank you!

    Hi Tony,
    As I understand it you are Italian and living and working in UK. Your new wife (many congratulations by the way) is Filipino and living in Philippines.

    The good news for you is that EEA Route for an EEA familiy permit is fully available to you and your wife.

    In principle there is no need for the EEA national to already be in the UK, to have an NI number, to have money, to have suitable accommodation, to have been married for more than a day or to have the spouse pass any English Language test.

    The extra special good news is that there is no application fee for an EEA family permit.

    EUN2.4 What are the requirements for issuing an EEA family permit?
    In assessing an application, the ECO should be satisfied that:


    1.the applicant is the family member of the EEA national (marriage certificate, birth certificate or other evidence of family link)
    2.the EEA national is residing in the UK in accordance with the EEA Regulations (as qualified person if more than 3 months) and the non-EEA national is joining them; or
    the EEA national intends to travel to the UK within 6 months and will have a right to reside under the Regulations on arrival, and the non-EEA national will be accompanying or joining the EEA national; and
    3.if applying as a spouse or civil partner, there are no grounds to consider that the marriage or civil partnership is one of convenience (see Annex ….); and
    4.if applying as dependent family members (dependent children 21 and over and dependent relatives) they are dependent on the EEA national or the EEA national’s spouse or civil partner; and
    5.neither the applicant nor the EEA national should be excluded from the UK on the grounds of public policy, public security or public health.
    It is important not to test overall intentions in assessing applications for an EEA family permit. Also, there is an initial right of residence for 3 months, which means that an EEA national does not have to be exercising a treaty right immediately on arrival in the UK.

    hi I'm just a newbie here i have read your reply and it gives me and my husband hope to be together in london, though when i realized this was way back 2011.. does this still comply until now? since there are many changes in the rules lately and is it me or him who is to apply for the grant.. well the last thing i want to have is more years apart from my husband. i hope you can help me with this please thank you

    In today's visa applications an English test is required, my wife did an ESOL English test last year before we applied for our visa - and we applied after the New Rules came into force!

    KeithAngel is asking about your husbands nationality because if he isn't British, but an EU citizen living here in the UK then you don't need to do any English exam.

    That all said, judging from your English writing in your post I think you would easily pass ;)

    It's changed a lot since Mar got her visa. We had none of the sort (language test), whilst at the same time, i'm all for it :D no more generations of people who don't at least try to learn English :D ... Hope that doesn't make me sound too much like Nick Griffin.

    I don't think it does.. There have been times in a professional capacity I have to call with the help of an interpreter because someone comes to the UK, lives here but can't speak English. It is annoying especially when people think the onus is on me to translate to them.

    That said, I bet some of the British expats in the Philippines by and large speak very little of the native language used in their locality. So perhaps we Brits are worse for not learning the local language and fitting in!

    Yes he is an eu in uk. That's sure great news for us. I just feel bad that the laws has been changing and requirements are piling up just because of those non-genuine relationship it affects the real subsisting one. Well that's all thank you for the reply and compliment.

    Great news missy ,the HO are introducing an ( almost certainly illegal) application charge of 55 pounds from july 1 st
    If your husband is a student or self sufficient he will need a comprehensive health insurance unless he has a permanent residence card

    Hi there, my fiancee is really british work and born in UK. That also mean i need to passed and get my english test??.. how about passing the IELTS it would be okay??...

    You will need to have passed an English Language Test from the UKBA approved list to be eligible for a spouse or fiancee visa. For Filipinos this isnt too difficult.

    CEFR is the standard. Here is the IELTS equivalent

    I think when my wife done the test 4.5 IELTS was the minimum but im not sure if that has changed since the B1 rating. Incidentally if anyone recalls we had a thread talking about retaking the test for FLR and i posted a confirmation email id received. The email said as long as you passed the current CEFR lvel that you dont have to retake the test. Im now hearing that this might not be the case according to a friend who is currently applying for ILR. I will dig the thread out when im on a proper device
