FLR / BRP 2nd renewal

    My wifes 2nd FLR Visa/BRP has been re-applied for, however, since Dec 2016, i have been UNWELL, on ESA, now Ive been given the all clear to return to work, but im currently unemployed,
    Up until Dec 2016, I had earned more than the £18,600, just
    My wife works, earning roughly £1200, does anyone know, if this may be a problem,

    Good question Bruce... I'm sure @Timmers will be able to help you.

    I think you'll need to give a bit more detail - exact dates and exactly what your wife earns and how much you get from ESA and whether you have any other income or savings that can help...

    Perhaps a personal letter to Mrs May telling her how much you appreciate the changes she introduced ... :)

    When you say "re-applied for" do you mean you applied before...or have now applied already?.
    If you have applied now...and paid the fee....then if you don't meet the financial requirements the eco may well have to refuse

    I suggest you write in and explain your situation....see if they can put your application on hold till you can meet the requirement and show 6 months earnings..

    It doesn't matter what the wife earns it's all about the sponsor

    wife's earnings can be included in the financial requirements for FLR

    ... if the sponsor doesn't meet the financial requirement alone.

    yes. cant be on the first--simply because that applies to a fiancee visa " converted" to spouse visa--so wouldnt have BRP till after the FLR was issued--therefore couldnt work.

    So when my wife is about to apply for he's second one then her earnings could be taken into account! I always thought that until she got ILR it was down to the sponsor!
    So when her daughter is ready for 2nd flr then her mums pay and mine if I semi retire will do?

    dont think ILR requires an earnings requirement.

    how long was her daughters visa for ?

    There is still financial requirement for the ILR but rumor has it that when the forms will be updated in July 2017 it might be removed but there's no guarantee.

    Did you not research the rules prior to your making the Application? We have all been through similar dilemmas some more some less. You choose the lifestyle you pay the price. One member who has already contributed to this thread even downsized properties to meet the needs...

    And he'd have been pretty stupid to do that if he could have used his wife's earnings to support his application!

    Anyway, good that there are others on here who do know the rules.

    All the "banter" on here is making it all a bit unclear.

    The first application, for an entry visa, it is just the sponsor's earning that are taking into account.

    Once the person who is applying for the extension is able to work in the UK, then their earnings can also be taken into account.

    I believe Timmers's wife used her own earnings due to it being easier than using his own self-employment earnings.

    Well said Maharg, there's no point in anyone repeating what Bigmac's already stated - "wife's earnings can be included in the financial requirements for FLR"

    Doing that would only make things more unclear...

    And detract attention from the fact that Mattecube our Trusted, Well-known-member and Top Poster for the month (who likes to accuse others of not doing their research) obviously hasn't done much himself!
