    Hi guys,

    I have a question hopefully you can help me, I've been searching for the answer but can't seem to find a black and white confirmation.

    I'm British guy and my Filipina wife is pregnant with our first child and due on May 22nd, currently we are both in Singapore.

    Now I have been offered a job in Gibraltar, I believe the UK spouse visa requirements are not in effect here and they follow the EU legislation?

    How would I go about getting her a settlement visa for there?

    Then I know the rent in Gibraltar is expensive how long would it be before she would be able to cross the border for us to reside in Spain?

    I have not thought too closely about this, but why not look to live in Spain? I was already resident in Spain when we married but it was so straightforward and at that time, I think all we needed to get to Spain and submit the application for Residencia was a visa costing 30 euros.



    Many people live in Spain when they work in Gib and being ‘trapped’ in Gib would be like living in Alcatraz

    My suggestion would be to (your missus) apply for a schengan to Germany (since Spain is not complying with European law at the moment at least in the Fils) then travel down to Spain rent a property start work over in Gib and both of you will get residence cards in based on your self suffuicency you will need private medical insurance

    Not wanting to split hairs, but EU citizens register on the EU Citizens Register at the National Police Station which covers the area where they are living. Once registered that lasts for ever.

    Non EU citizens require a Residencia. Application is made at the department for foreigners for the Province they are living in. It is valid initially for 5 years.

    They are in realty different as are the requirements for each.

    Keith. As I live in Spain, I would be interested to know how Spain is not complying with EU laws.

    Before we were married (it was 10 yrs ago) I asked the consulate in Manila what was the chance my wife would be allowed to live in Spain? They looked at me as if I were stupid and said, "Where else would your wife live but with you in Spain?" All the dealings had with them (unlike the UK Consulate) were very straightforward and they were always friendly and helpful.

    I of course agree with you John but having had our own problems with haughty and stupid Embassy Staff the trick is ,in my opinion not to get caught in there web of nonsence but to focus on the objective , which is to presumably to be with the Missus in Europe to which end any shengan will do and with the changing climate as soon as possible It may be that there is no problem with Spanish Consular understanding from Singapore

    To put it mildly.

    The latest is that because the marriage is not registered in Britain - It can't be. There is no register - my marriage will only be classed as a de facto marriage.

    I have explained to them that it is their reasoning that is in fact de fecto, and the laws they quote not pertinent to our situation, and that what they are doing is illegal, but no response, not even from the Defensor del Pueblo.

    I should write to them asking for permission to marry here in Spain. Because if they can't grant me that, then it can only be because they consider me to be already married. They can't have it both ways.

    I've had enough of these f**king idiots. We will apply to Malta, and hope that Melody's THREE Visa Denied stamps don't cause a panic and provoke another refusal. Then in all seriousness, anywhere other than this country of morons will do. (I'll tell Melody not to completely unpack)

    Thank you for the response, I considered going to Spain but I wondered if there may be a problem at immigration when they see she is pregnant. So if we were to travel via Germany we can just take a tourist visa then apply for residence in Spain

    The new employers have offered me a May start or July start date so maybe we can deliver the baby in Philippines then they can join me later on in July.

    Theres no problem with your wifes pregnancy except flight restrictions

    The issue as I intimated earlier is that if the UK votes to stay in Europe this may change free movement rules

    Now is an excellent time whilst all remains as per the Directive

    Entry for the first 90 days requires no act other than your presence in the State

    Im not 100% sure but any child born in Spain might well have three Nationalities in this case
