Hi all! Pinay here from Rizal and currently in a relationship with a British national. And right now we are trying to find a way on how we will be able to start our lives together. Im still married but my annulment is on going and we are looking for some options, we have been reading alot on the internet about different visas like unmarried partner visas which we are so interested but no one can give as a definitive information about it. My bf even spoke to some solicitors already in the UK but they saying need my divorce sorted and get married. Is there anyone who can give us knowledge about the unmarried partner visa? Many Thanks!
Hello Nhed. The advice of the solicitor is probably correct. I personally havent heard of anyone going down the unmarried partner visa route. With that visa you effectively have to be in a relationship for at least 2 years and that relationship has to be as though you are already married. I guess that means living together, sharing household bills and such like. Are you currently co-habiting?
hi Nhed--welcome to the group--i agree with what @HaloHalo has said. plus--unmarried partners still need to be free to marry if they chose to. so you still need that annulment.
Hello Nhed welcome to the forum. Unfortunately, as stated above, the unmarried partner visa would be for those couple who have been living together for at least 2 years (and of course not previously married to anyone). I'm afraid your only option is to wait for the annulment and apply for a fiancé visa or if you want to marry in the Philippines then you can apply for spouse visa.
Hi there HaloHalo. We are renting a condo here everytime he come around to see me plus i visited him for a holiday in the UK last year and we are planning again for my 2nd visit before the end of this year. Isn't that consider as co-habiting?
Hi Brom27. Seems nothing we can do about it, i think i agree that we need to wait for my annulment to get sorted. Maybe because ive been reading alot on the net i got confused about the meaning of unmarried partner visa..
Personally I wouldn't class renting a condo upon his visits as co-habiting. Co-habiting would be more like a marital home in that it wouldn't be a temporary abode. Others may see it differently including an ECO but as stated your best bet would be fiance/spousal route.
living together means more than visiting. things like--shared financial responsibilties--joint bank a/c. in the uk--such as council tax and utilities in both names. joint motgage or rent agreement. insurance policies in joint names. the onus is on the applicant to prove they are living together as a couple.
the problem with unmarried partnership--as far as UKVI goes--is the 2 of you have to prove you have been living togeter for 2 years. you cant in the uk--so he would have to live with you in the philis. then--how does he prove his income for the period--has to be £18,600 a year. how can he earn that in the philippines ?
