How to apply for a Partner/Spouse Visa Under New Rules

    Only the sponsors income is relevant to the application, you have nothing to worry about.

    If you're talking about a marriage visa then you are the sponsor and solely responsible for the financial requirement. If your partner enters the UK married then she can work straight away and help you with the next visa. If she comes to the UK to marry then she can work after the first FLR application.

    Hello. I have a question:

    My tourist visa just expired last month. When can I apply again but this time for a Family Visa (Unmarried partner)? Do I have to wait 6 months after my tourist visa expiry date? Me and my partner together with our son went to England last December for a short holiday. Insteas of going back to Manila together, we decided he should stay because he was offered a good job by his mate. Me and our son are now back here in the Philippines and I'm planning to arrange my family visa requirements so we can join him soon. Only thing is that I'm not quite sure whether I can apply right away or have to wait a certain period of time.

    You can apply right away. If you are applying for another visit visa then can't but since its settlement visa you can apply whenever you can.

    Unmarried partner visa? Are you sure you meet the cohabitation requirement for that? Or are you confuse with the type of visa you are appling for?

    Me and my boyfriend are unmarried but we have a child together. So I plan on applying the family visa. We've been together for 3 years already too. Also, thanks for answering my question. I'm so delighted to know that I can apply right away if it's a different type of visa.

    Is it also possible that my partner's mother stand as my sponsor or should it always be the partner if the family visa is sponsored?

    It's your boyfriend who should sponsor you. He should meet the financial requirement.

    Is your partner British?
    Where is the child and what nationality is the child?

    Third party sponsorship has been abolished when the rules changed in July 2012. One thing his parents can do though is give him a cash as a gift to help you meet the financial requirement. :)

    My partner is a British Citizen, our son is a British citizen as well. I was married 5 years ago but got permanently separated after a year. There is no law yet that can support a no-fault divorce in the Philippines but me and the 'ex' (also a Filipino) is currently living our own separate lives and he is also well aware that I have a family now. My situation gets more complicated as my partner was currently hired in the UK last Feb this year. Even if his annual salary meets the financial requirement, he just got hired for less than 6 months and been away for more than 3 years so he cant submit 12 months of previous income in the UK. So we are looking at having his mother as my sponsor.

    Will it be impossible to get a family visa if Im still married on papers but permanently separated?

    It's a problem I'm afraid. Your previous marriage should be dissolved first before you can apply for a settlement visa. :(

    It's not impossible if you go through the annulment process.

    You miht need to consult an immigration expert. Do you have papers to state that you are 'separated'? The thing is that 'separated' is saying you are not living together but are still married to your ex so you or your ex cant get married to anyone until that marriage is annuled. Annulment might be easier if you are in that status.

    Im not sure if you can apply for settlement visa with that status.
