How to apply for a Partner/Spouse Visa Under New Rules

    My wife is going to Manila for her CFO interview in August. Hopefully she will pass that then we can apply for her spouse visa. Reading through this post I saw something about a sponsorship form. Is that a requirement in our case as I see the sponsorship lasts 5 years and my age is 63.
    There is no requirement for me to retire before age 70 and as long as I can do my job I can reamin in employment. I dont have significant savings so is this likely to be a problem?

    Hi Jim
    A few questions

    Has your wife passed her English test?
    Has your wife got the TH screening ?

    You don't need the cfo sticker to apply for the visa, you will need it however for her to fly.
    Most people get the visa and then attend and obtain the cfo sticker.
    Some will apply for the visa then do the cfo seminar and go back for the sticker once they have the visa.
    Yes there is a sponsorship form along with the electronic application form( hard copy required for your application pack) also a finance form hard copy printable off the visa website.

    Earnings need to be £18600 per annum and you will have to document evidence of this in 6 months worth of payslips submittable in your application pack, if you don't earn this amount there is a calculation for pay plus savings.

    once your wife is here ( and gets her BRP ) she can work--if she wants to.

    the next time you need to show sponsorship is when she applies for FLR after 30 months. at that time her income can be used in addition to yours---and any pensions you may then be getting. so long as you meet the £18,600 pa ( at current rates)--it will be fine.

    Thanks for the replies.
    We are both getting very nervous thinking have missed something, here is the current situation:
    • English test passed (we hope there is not an expiry date)
    • TB test passed ( but there was an abnormality and a check up reccommended)
    • I am in salaried permanent employment have more than 12 months payslips and p60
    • I have a small pension income approx £1k a year plus salaried employment income of £30k
    • We married in Hong Kong and the marriage has been registered in Phils
    • I dont have children under 18 or still in education. My wife has no children so the £18.600 rule applies
    • We have substancial proof of a relationship including rental agreement of a property we lived in as man and wife, a signed statement from the property owner notarized and confirming we lived there 2 years. Numerous photos of us together in Phils and with family ( some dated 2014). Screenshots of Skype and Facebook chats. Stamps in my passport and my (expired) ACR card proving Phils address.
    We heard stories of the CFO interview being hard sometimes so we decided to get that passed then apply for the visa and get the sticker if (hopefully) the visa is issued.

    Points of concern:

    • Age difference 40 years ( yes we know its big but we have a strong relationship of over 4 years and living together in Phils)
    • I have no significant savings owing to the fact I am paying to support my wife in Phils and pay rent/bills here in UK plus covering the costs of flying to and from manila for the visa process.
    • My accommodation. I am currently renting a room from a friend to save money. My friend is the property owner (mortgaged) and is willing to sign what is needed to say that me and my wife can stay there until we find accommodation of our own. The property is a two bedroom house and there is no overcrowding issue.
    Any advice or comments on our situation would be very welcome we are doing this on a budget and need to get it right first time.

    All looks good,dont forget TB certificate is valid for 6 months only,CFO is not hard if you are in a stable relationship!

    the age difference is irrelevant--forget it.
    you dont need savings--you earn above the threshold.
    as regards accommodation---you might want to get a survey done----other members can advise on this ( hopefully )

    also--the cfo seminar...again--maybe some of the members who have done it can reply.

    The survey is a good idea as we dont want to give them an exuse to refuse the visa best to cover every angle, thanks for suggesting that.

    Hi all, we're getting really close to having everything ready for our visa application.
    I just wanted to double check the Reason for visit, Visa type and Visa sub type on the visa4uk website.

    We're a bit confused as to what to select. All the naming conventions are so inconsistent and over the years its changed but basically we want to apply for the family visa entry as a spouse. With the aim to settle and thus gain ILR after 5 years.

    Background: He's a Filipino never been to the UK before but we did try a tourist visa.
    We've been in a relationship together for 11 months. We're a same sex couple that got married in the british embassy in Manila.
    At present he hasn't spent any time in the UK we need to select the visa that will allow us to live together here in the UK for 5 years.

    Do we select visit visa 5 years so that we can at the end of that apply for ILR or do we select Settlement Settlement Husband? Isn't the Settlement Settlement visa type for ILR after you've already spent 5 years together?

    The correct breakdown for a spouse visa is settlement-settlement-husband.

    Spouse visa will be valid for 33 months, after that you apply for FLR(M) from within the UK which will then be valid for 2.5 years. After 2.5 years you can then apply for ILR.

    Hi everone, i've got a question, which i hope someone can help with, i married my wife who is from the philippines in may 2017, and then appled for a settlement visa in july, my wife received her passport via courior with a UK entry Clearance sticker on it, with D-Marriage/CP Standard and my name, a valid date from october 2017, to april 2018, and no other documentation at all, i'm hoping to go to the philippines in december and bring her back to the Uk in january, can anyone explain what happens once she arrives here in the UK, does she have to go back to the Philippines after the April date, or can she stay in the UK, and if she does, when can she come back, and do we have to re-apply for another settlement visa again at an extra £1400+

    This is Strange.....

    settlement VISA is 3 years. timespan quoted is six months!!!!??????
    Please ask her to photograph and send to you the information in her passport.
    I hope it's not a standard visit visa???
    Puzzled.

    Hi Rob, she already sent me a copy of her passport, on whatsapp, and it clearly shows a valid from and to date from 26 october 2017 to 26 april 2018, do u think the embassy have sent us the wrong visa, and if its a standard visit visa, have they charged us too much, it was £1,427.28
