How to apply for a Partner/Spouse Visa Under New Rules

    We just stuck 4 photos to an A4 sheet different times places etc about 50 photos.

    Posting for a 3rd party...

    If you believe that the reasons given for a refusal are inaccurate what should you do? Do you have to go down the long Appeal route, or is there another way to explain why you think the decision is wrong? TIA

    You could look at this if its applicable, have you been given the right of appeal if so you cannot use the Administrative Review but if not given the right to appeal read on

    I have asked the '3rd party' what it says at the end of their decision letter - still waiting for a reply!
    So, if there is a right of Appeal, are you saying that - long, drawn-out route - is the only option available, even if you believe the decision has been made in error?

    The options if you have been given the "right of appeal is to appeal" is indeed to appeal or start the process again addressing the refusal reasons in any subsequent application.

    A most useful post but can anybody advise on how to apply for both my wife and step daughter to join me in the UK, is it one or two applications required and what applications should I make?

    2 applications---settlement spouse
    settlement dependant relative or child--whichever option is listed---how old is the child ?

    Thank you so much. Child is 6, father Canadian working in UAE, never been to Philippines and has signed consent letter for her to come to UK. There are 2 options on visa4uk, one says apply for myself and another apply for Someone Else do I am guessing the someone else is where my wife applies for the daughter?

    correct. a spouse visa is quite straightforward--provided you meet the sponsorship criteria. a dependent child application is not so easy. there have been numerous threads on here this year about successes --and failures ( including us ) i suggest you read through them--and ask questions if youre unsure.

    My fiancee was registered at birth as male by mistake at the local municipio.
    I am 99.9% sure that she's a woman, I've looked .
    I just wonder how we change it on the visa application.

    You can't. Unless she can get the Birth Certificate amended, she will have to apply as a male. Her Passport also presumably states "Male" as her gender.

    You can get the mistake corrected but it will take time - up to two years or so - and several court appearances. The cost is not insignificant.

    To be honest I wouldnt even try applying until she can get the birth certificate corrected first.
    First question any official body would ask is why has it taken so long to come to light?

    I thought things like that could be "notarised". Reality can be changed with the stroke of a pen and a rubber stamp.
    She just writes 'I am female ", a notary stamps it as true and voila, she has changed gender officially.
    Maybe not for a family visa.
    Yes, I will tell her to go to the municipio.

    Hi you mentioned here about the proof of accommodation, my husband has his own property in the UK and not paying any mortgages anymore. You mentioned about Certificate of Deeds, where should we get this from? and also about the Housing Report if you are aware on this where should we get this as well? Appreciate any help. Thanks

    Thank you. My husband saw this and already contacted them but he is worrying that if they just sent by email would this be enough to confirm his certificate of ownership? as he read on other website which seems to suggest to provide original documents should be provided, could you let us know if by confirming thru email on land registry would be enough to support our documents? Thanks appreciate your help

    We are still awaiting for the outcome of the visa so I am assuming what we did will suffice.

    You have two options. There is the online title search which is not an official copy but which gives the owner of the property and which I believe will detail who owns morgages as well. I dont have a morgage which is why I say I believe it will detail that.

    Will get the results of the search straigh away and then download in pdf format and print. If in a hurry only real option.

    Be careful if you use google to get as there are commercial organisations who charge more. Almost posted link by mistake. Each component of registry costs £3 so if asked to pay more then check on correct site. I got title register entry and title plan but think you only need the title register entry as it shows the owner. Checked back at the order and it details when obtained.

    Alternative is to get the official copy which means filling out a form and sending a check off to the land registry. They then send it in the post. Official copy can be used for legal purposes. Supposed to be less than a week to get from sending form and check off to getting it back. I though it took about two but cannot remember exactly when I sent the form off.

    I used the online copy of Land Registry to prove accommodation when I applied and I didn’t have problems with it.

    Yes I used this method in 2012 and the visa was granted. When I paid my mortgage off the bank told me that homeowners dont get the physical deeds to a house these days so the online request is fine.

    Although slightly off topic here, those that have paid their mortgage off are slightly vulnerable to having their home potentially sold without their knowledge. The land registry have a notification service that you can set up (free) that will notify (obviously) of anyone requesting documents/details of titles of your property.
