Yeah, it worries us that they'll use it as an excuse to reject our application. :( We didn't think about it before submitting our application. Anyway thank you so much Gravesy, now it's up for me and my fiance to decide. :)

Here's another question... sorry for this.... If we do decide to reapply, can we do it right away even though they are still processing my refund request?

You can reapply right away while waiting for the refund, if you cancel the application.

It is indeed a tough call. As far as I know the moment you submit the online application that is where you start counting for the financial requirement.

Look at it this way, when you were answering the questions online like if the savings were held for at least 6 months which clearly isn't and you already confirm the application so they have the right to argue that at the time of your application you didn't meet one of the criteria to use cash savings.

Dont disagree however equally you could argue that when they review the papers the six months will be in place like you say a tough call, and I think it would be ok if the rest of the application is strong, just a view I guess that there is no absolute concrete answer to, with it being a matter of days|

Yes I know. In some senses they should accept it since clearly they won't look at the documents right away and by the time they do they already meet the 6 months.

What worries me is that they were answering the online application (and confirmed it) saying that they have had the savings in the bank for at least 6 months which clearly isn't so it is indeed a tough call.

depends on 30 day months or 31 day months!! I think its the applicants call based on the responses that have been supplied.

On a differant note ,any luck with the job hunting?

Thank you Mattecube and Brom for the insights... I just want to say that this forum is our little angel, without all the help you guys gives we'd be so lost. :) My fiance and I talked and we decided to take the safer route and just reapply, would save us from heartbreak if they decide to reject us coz of our little mistake. :D

Very similar circumstances, I recall. Just a few months in it. But they got turned down because of that - initially.

I know this topic is about if you're planning on getting married, but what about if you are just in a relationship? And we miles apart at the moment, but we want to together and she wants to come to UK to make the relationship more real then just 'long distance' and 'online relationship'?
If this is the wrong place for this post then sorry I'm still new to this site and still try to find what I'm looking for.

You need to meet first in person at least once to qualify for this visa so a visit visa for her to come to the UK is good. Or if you can visit her to PH that would be easier.

a non-married couple can apply for a settlement visa--snag is you have to prove you have lived together as a couple--for 2 years. so you would have to live together --but outside the UK. plus--you --the sponsor--still have to meet the earnings rules.

But I am from the UK I was born here, I've never lived out of the UK, the UK is my home, how come I would have to live outside of the country where I belong?

but she isnt in the UK--and cant be without that visa !
in order to get a settlement visa as a non married couple you need to live together for 2 years----which you cant because she cant live here --a catch 22 situation. so you would have to live with her outside the UK.

I have already submitted my application at vfs but they didn't ask us pay the health care surcharge to apply for a Settlement Visa. Do we need to pay the health care surcharge?
If we do need to pay the surcharge where do we pay it?

    Many thanks
