Need some help for financial requirements for ILR

    Good day
    Hello everyone I needed some help about financial requirement. Please help. I will apply ILR Set(M) in few weeks. I arrived in Uk Aug 2015. I am the applicant. My previous 2 application for spouse and FLR visa was under Section 7B - maintenance as my husband receive DLA . My FLR visa (2018) application was combine source of income my husband DLA and my work income.
    Today my husband receive letter that his DLA has been stop. I cannot used section 7B as his DLA been stop. I am so worried now. I work full-time as a carer for 4 1/2 years in same employer. I compute my gross income for the last 6mo. its more than £18,600 applying with no child dependent. My husband has no work as his one leg been amputated.

    1. Can I use my own income as a carer to meet the financial requirement of £18,600 for ILR

    2. Which Category I belong A or B?

    I had my employment contract, 6mo payslip and 6mo bankstatement is this enough to show I earn enough to meet financial requirement

    yes--you can use your income to meet the financial requirement. i'm not sure which category you need to use...the application form should tell you--and the evidence you need to provide.

    1. Yes you can use both your and your Husbands income, its overall income not just income from you or your husband..

    Im guessing your Husbands DLA has been stopped/reduced and he has been put on PIP https://www.gov.uk/dla-disability-living-allowance-benefit/DLA-rates I suggest that he appeals against the decision https://www.gov.uk/mandatory-reconsideration and he could also contact his local Citizens Advice Bureu to help with the appeal, this certainly seems harsh when someone has lost a leg, especially when their are people out there perfectly able to work, but wont..

    is PIP now one of the exemptions for the earnings requirement ?

    Looking at this Malcolm it seems to be..

    The applicant and UK partner will need a combined annual income of £18,600, unless:

    i) The UK partner (or child) is in receipt of any of the following benefits: Disability Living Allowance; Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme; Severe Disablement Allowance; Industrial Injury Disablement Benefit; Attendance Allowance; Carer’s Allowance, Personal Independence Payment; Attendance Allowance; or Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme.

    Without knowing the ins and outs of the case, I would have thought it somewhat harsh to stop an amputee,s DLA support without moving them on to some other kind of support.. I realise this discussion is of minor importance to the Topic poster as she meets the income requirment with her salary, however if her husband does receive PIP i would have thought it easier to continue as before..

    Hi. Yes my husband was in DLA then last year they send letter that DLA been changed to PIP. They send letter to fill up and was assess again and and we never heard from them since. Then this week we received letter that they cannot give PIP based on the assessment. The thing is his leg will never grow back and cannot work because of his condition. We appeal hopefully will turn to positive based on all evidence we gather about his condition, but I don't know how long will take. My visa is due to apply next mo. using my own income, luckily I work and earn enough for financial requirement of £18,600 with no child.

    Hi Heathen. Yeah It could be more easier for me to continue what category I had before and I<m confident to show them to meet the adequate maintenance as couple with combine sources as my husband receive DLA. And now my financial status been changed. but I really thank full on this forum really help me a lot to answer some of my question. And you guys confirm that I can use my own income as applicant to meet the financial requirement without the help of my husband(sponsor) income. I really appreciate and Thank you.

    Hello bigmac. Sorry to ask again, As Non-salaried Category A. should I fill up also this section as no option for Non-salaried . Thank you, Sorry if I'm pain in the ass to ask this silly question.
