    Hi everyone.. I might need some help.. I dont know where to put post... My English was not good because I am profound deaf. My partner from Philippines. She has been married before she throw her husband out 12 years ago because of abuse physical and drugs.. We met two years ago. She has been here UK twice with Visitor Visa. Now we decide for her to move here UK but She have to be annulment which will take 2 years. She was not sure if she can divorce here UK. How do it work out? So far I know that I could live with her in Philippines for 2 years then apply partner visa but I cannot live there because I have two younger kids here and work. I hope someone can advice me how to process for her move to UK then I will get marry her here UK. Thank for watch

    1 - You will not share the same roof in the Philippines, for fear of her ex reporting you and her to the police.. Serious business...
    2 - You cannot initiate any divorce proceedings or anulment from the UK, unless actually married in the UK.

    Your partner needs to start annulment proceedings, which will go on and on and on for a couple of years or more, being a very expensive process and you may have to sponsor, all this while keeping your head down and yourself well in the background because the moment the husband finds out that there is a Kano involved, trouble will come aplenty..

    After the annulment, she can marry again and then apply for settlement visa.

    Does your partner sign in English?
    Along road ahead to get the divorce then settlement visa I would of though in excess of 4 to 5 years.

    to qualify that:
    my ( now ) wife did divorce her filipino husband whist she was living in the UK on a student visa. she filed for divorce here in 2012--and it was granted ( 5 years separation--no consent needed ) after she had returned home.

    we thought at the time it would be enough to enable her to apply for a fiance visa--but couldnt get 100% confirmation whether we were correct...so she subsequently filed for annulment. ( again--from in the UK--she was here on a visit visa then late 2013. )

    all in all --a very expensive process.

    i suggest you seek legal advice here in the UK as to whether she could file for divorce here during her next visit ( visa lasts up to 6 months ).

    or--as was suggested to me by a very experienced former member---both of you go to the US and get a quick divorce there. maybe even a quick wedding too. then you each return to your own country and she applies for a spouse visa.

    I thought you could only initiate divorce if you have been living in the UK for a year or more?

    can i ask @whizzbread --if hes reading this---is he fully aware of the sponsorship requirements for a settlement visa ?
