As promised you will find it here
show that this is current guidance and not an archived document, here is the link trail I followed:
Starting here, click on Immigration law and operational guidance, then Immigration directorate instructions, then Chapter 08: appendix FM family members, then Appendix FM 1.0a: Family Life (as a Partner or Parent): 5-Year Routes.

The relevant part of that document is section 4.1 which says:

"A person in the UK with entry clearance or limited leave to remain as a partner granted under Appendix FM on the basis of an application made on or after 9 July 2012 should apply for further leave to remain no more than 28 days before their extant leave expires or no more than 28 days before they have completed 30 months in the UK with such leave."

my comment, the idea is that you can apply at 30 months which is 2.5 years thus not encroaching on the 5 year rule (2 periods of 2.5 years equals 5)
The idea of the first period being 33 months is you are issued with a vignette for 30 days (1 month) so it's 32 months some instances of traveling later.

    hope this helps

Hi Mattecube - thank you so much for digging it out - glad they make it obvious - that helps a great deal as it happens we were just looking at the calendar as Jasmin arrived on 7 April 2017, so I think today is exactly 2.5 years/30 months on from then. I won't be celebrating this particular anniversary just yet... currently wrestling with the application questions about does she rent, as I pay the rent so am thinking to put neither own nor rent, but at least I know we can apply now as soon as we have the docs compiled.

One point, when I follow the link and the clicks, I can't see the section FM 1.0a Family Life on the penultimate page

    https://www.gov.uk/government/publications/chapter-8-appendix-fm-family-members

Not bothered for myself but others may refer to your good advice so thought I'd flag it, unless I've gone wrong somewhere as usual.

    Thanks again :like:

Congratulations! I have started collecting my documents for my 2nd FLR.
I have a question, we are renting my father-in-law’s house. We don’t really have a tenancy agreement so the only thing I can get is letter from him confirming that we are renting from him. To whom does he address the letter to?
Also my husband’s employer will make a letter confirming his job and annual income aside from the employment contract. To whom does he address the letter to?
    Thank you in advance!

The letter from my employer was 'to whom it may concern' and Re: Mr XXXXX YYYYYYYY
    It included:
    my address
    DOB
    my employers name and address
    my payroll number
    my job title
annual salary for the year 2019-2020
annual salary for the year 2018-2019 (the six months payslips spanned both financial years)
    contracted hours
date of commencement of my employment
it stated that my contract is full time, permanent

We also submitted a signed copy of my employment contract.

    Good luck!

Thank you so much. I have my husband’s employment contract and a letter from his employer.
My husband’s basic annual salary meets the financial requirement, do I still need to show them that I’m working and we are paying for all the bills together?
Also, do I still need to send photos and chat logs? Because from what I’ve read from the others that I don’t need to send them anymore. I just want to make sure

No need to show you are working no need for chat logs or photos.
At the end of the application you will get a documents checklist this may refer to send joint communications
    Good luck

You need to supply ( I think these are the figures) 6 letters addressed to you both spread over a 2 year period or double that 6 each addressed to you and 6 addressed to hubby. It will tell you on the automated checklist
They can be from the same dource

For my correspondence letters, I have:
1 HSBC Joint bank statement July 2017 - Jan 2018
2 HSBC Joint bank statement Jan 2018 - July 2018
3 HSBC Joint bank statement Jan 2019 - July 2019
4 HSBC Joint bank statement July 2019 - Jan 2020
5 Council Tax March 2018 under both names
6 Council Tax March 2019 under both names
7 TV Licensing under hubby's name Feb 2019
8 My Maternity Leave Letter Jan 2020
    9 My HM Revenue letter 2019 - 2020
    10 Hubby's HM Revenue letter 2017 - 2018
The Joint bank statements are addressed to my name but the account is under mine and hubby's name.
    Are these enough? Thank you

Someone with more knowledge than myself may offer more accurate thoughts but I believe the idea of the documents are to prove you have both been living at the same address over the 2.5 years.
I wouldn't be confident in using a document that is not clearly addressed to both of you as proof.
You can mix and match as long as the total documents equals 12, e.g. 4 documents in joint names plus two with your name and another two with your hubby's name - in this case the joints documents count as 8 and the others (2 and 2) make the total 12.
Do you have other documents which could be used?

Yes, I have 2 documents more for each of us. The problem is our bills can be accessed online now so we don’t have them on papers anymore. Also, for payslips, we’ve gone for paperless at work I printed it off from online do I need to have it certified?

I printed bills online, my thinking is that you are going to scan then upload them so you are not really submitting originals anyway.
I downloaded my bank statements and submitted them, they were accepted.
I got HR to sign my payslips that I had downloaded just to be safe.
We are living in the digital age!
