They actually wanted me to just refund my application and post a new one under same sex civil partners.

But I insisted that I picked the correct category.
I hope I did the right thing.

Now I know why most of the visa processing solicitors didn't accept my queries. They said they don't process same sex settlement visa.

    It's a scary process.

this is a tough one for you.

if it were me--i would take that advice--and re apply. it would also give you time to get that genuine copy of your partners passport stamped and signed by a solicitor. dont forget--also fresh bank statements and wage slips if the present ones will be more that 28 days old. a DHL envelope should get to you in a week. dont rebook your vfs appt till you get it.

i just think--the way it is now--your application is a bit weak--several issues with it.

    but--its your money--and future.

Yea. But I was pretty confident that I got the right sub type.
They said marriage and civil partnership for same sex is just the same.

But that's not the info we got when we are at the uk embassy applying for marriage notice.

We picked marriage instead of civil partnership.
So legally, we are a married couple and we can't declare ourselves as civil partners because it is not legal.

That is why I insisted. And they seem a bit confused when I told them about that. Which made me think that they're not so sure about the advice they gave me.

They accepted the scanned copy of the passport.
And I also submitted his birth certificate.

    They said it's enough.

I got relieved when they accepted it.

Then the doubts on my visa type happened

They said the they treat the same sex marriage under the civil partner visa sub type.

I'm not sure how can I be able to have it corrected now that I have submitted my application.

Just in case (hopefully not) they decided to deny my visa for that, is it possible to appeal the decision?

The only possible issue I see now is that my visa sub type is Husband instead of the Civil Partner which they said is the necessary option.

Is it possible? So I can prepare for it in advance. But I'm still hoping for the best that it will be approved.

Anyway they are still under the same settlement visa and same documents and fees. Fingers crossed.

Just another point folks - during the 5-year ILR process, is the Filipina spouse allowed to exit the UK? Tried looking online and it's all very confusing - maybe due to the large amounts of alcohol i have been consuming this weekend in celebration - hic! ;)

Any links you can throw my way would be much appreciated :)

Yes she can exit the UK no problem, see the attached to give you an idea of the amount of days she can spend outside the UK without it having any effect on getting the ILR.

Another very general question related to this though this may have been asked a lot of times here, sorry. I got my leave to enter visa as spouse which I need to renew after less than 3 years to ILR. May I ask how long does the ILR visa lasts for us to apply for citizenship?

    Before you apply for British Citizenship you need to have had the ILR for one year, all the details can be found in the link below;

    Hi all,

Visa application was all booked for June after the 'formality' of picking up a new TB free certificate a few days before, but of course the clinic in Manila decided my wife needed to have a sputum test so the application had to be cancelled.

Last week we finally got the all-clear and the TB certificate, and my wife is also taking the IELTS for UKVI 'Life Skills' test on the 25th Aug after it transpired the IELTS test she took last year (at the newly approved test centre...) was no longer valid.

At this present moment in time I'm trying to begin a new Visa application online, only for the last two hours I've been unable to log into https://www.visa4uk.fco.gov.uk/Account/Login due to the site experiencing 'heavy demand'......

As many will know, the site is only a BETA version being 'tested' and has been for at least the last 18 months.

In the meantime I thought I'd pick the brains of members here, to ask/confirm what new documents I'll need to send for the new Visa application.

For the June application I'd provided all the correct accounts/statements for the previous financial year ending March 31st, which will still be the 'last financial year' and valid for the new visa application in mid September.

So I'm assuming no further accounts need to be provided signed off by an accountant, but will bank statements be needed to cover the period since the end of the last financial year?

I'll probably send them anyway, along with printouts of the last VAT return receipt, and updated utility bills for my home, but if anyone has any further suggestion/thoughts they'll be gratefully accepted.

I will also send a note to add to the application, basically stating that the application was originally ready for June but had to be cancelled/delayed because of the TB test.

    Cheers all.

EDIT: Update. It's now three hours since I first tried logging into the online application site and still no joy. Now the woman charged with organizing visa applications is running the country. God help us.

Managed to finally log in and start a new application.

Filled in first section, then the second.

Clicked on 'next section' and after a long wait I was logged out.
Managed to log back in, and second section hadn't been saved.

Same's just happened again. Time to give up for today.
