If you are employed earning more than 18,600 you select complete 3a as you have done then select either the a or b option depending on whether you have been employed with the same employer for 6 months or more (Option A) or option b where you have changed jobs or your salary varies when you need 12 months of payslips and bank statements.

Apologies for taking up everyone's time further with a small point of detail re submission of bank statements. I have been in Quezon City from 6/11/18. We are now married and awaiting the marriage contract from PSA within the next 7 days. We then plan to submit our spouse visa application. I arrived with six months of bank statements, stamped and initialed by my bank taking us to the end of October 18 and can print off Nov, Dec and Jan statements with bank heading but obviously not stamped/initialed. Shall I provide the latter plus the previous statements with a record of my conversation with my bank on this issue, or do we need await my return to the UK at the end of January to verify my latest statements before application submission? Sorry to be long winded. Sure i am unduly worrying!!

Good morning all, Still relatively new group but it is great reading all your experiences- very helpful!

Apologies if not posting on the correct thread but I'm intending on bringing my wife and step daughter to the UK in August and have a few questions. Would be great if anyone had any experience and could answer one or all of my questions

    1. Can we apply for spouse and child dependent visa while in the Uk on tourist visas?

    2. After consultation with Uk immigration lawyer, we have been advised to ensure we have the correct child custody documents ie showing that my wife has full custody of her daughter, we are still on relatively good terms with the biological father and I'm sure he will sign them. Anyone know where to get the correct documents for this that will be accepted by the home office?

    3. Unfortunately I can't ensure I will have a full time job upon arrival in the UK so we are going down the savings, relying on an early inheritance to ensure I meet the threshold. Lawyer advised that this should be accompanied with a letter to show it is in fact an early inheritance and not just a loan- has anyone any experience of doing this?

    Thanks for any help/advice

    Hi @Davidb99
    In answer to your questions.

    1. No you cannot apply for spouse or child dependant visas while on a visit visa in the UK the applicants must be outside the UK at the time of application

2.You will have to demonstrate the mother has sole responsibility for the child, and the father is happy with arrangements being made for the child a good place to start is an Affidavit from the DWSD in the Philippines and associated reading from them. I take it the fathers name is on the birth certificate?
There have been a number of successful members getting the sole custody of the child so hopefully they will read your post and comment further on the finer detail, (my wife and I were in the unfortunate position that her daughters biological father was/is deceased at the time of our application) so it made things a bit easier for us.

    3. Any savings need to be in your account 6 months or more prior to the application! any lump sum payment supported by official letters can only be a good thing.

    Good Luck

    Thanks for the reply @Mattecube

Yeh the father's name is on the birth certificate and we are on relatively good terms so if know the exact documents, it won't be a problem getting him to sign.

    Thanks very much again

Sorry if this is getting tedious for others but what is simple is not always clear! We are awaiting the PSA marriage contract. Re the VFS options on visa type, there are marriage, marriage visit & settlement. Presumably it's the latter? Many thanks

typical VFS..not using the correct UKVI terminology.

    the options are-

marriage visit visa ( to get married in the UK then return from whence you came.
settlement:spouse----for a wife or husband to join their partner and settle in the UK
settlement:marriage----for a fiance(e) to come to UK to marry then apply for further leave to remain.

i have read a school of thought that if the remaining parent gives consent to a child applying to settle in the UK it demonstrates that parent still has a degree of responsibilty for the child.

better to prove the remaining parent has no contact with the child: has no part in the childs upbringing; and gives no support to the child.

even better if the remaining parent is not on the birth certificate

best of all if the remaining parent has died. proof will be required.

and to think i naively thought if the child chose to live with his mother in the UK that would be enough---and provided we met the sponsorship requirements it would be a foregone conclusion.

    a painful and expensive mistake.

It appears to us that the process could be made much more straight forward, except we think this is another test related to comprehension, IT skills and patience. All making this forum a valuable resource for all.

We are nearly ready for Spouse visa submission this Friday. My Filipino wife has drafted an excellent (Spouse letter) photo/text narrative (in the first person) about how and where we met and how our relationship evolved over the past 4 years, including post wedding material. I meet all the requirements re income, accommodation, etc and we will tick the appropriate boxes and provide documentary evidence. Should I provide a separate Spouse letter or perhaps my wife's letter could be a joint one? If so, what other aspects need to be covered? (Thinking best to avoid repetition!) Many thanks.

Good morning- thanks again for all your help

I'm preparing to submit our application in a couple of months for spouse visa with child dependent.

Just to clarify- I make an appointment for my wife and step daughter for biometrics at VFS and then send the documents to Sheffield? Or have the biometrics done and the send the documents to Sheffield?

    Thanks

    Dave

If you are in the UK at the time of biometrics I would send them immediately after biometrics just in case anything comes up or you want to add anything to the pack. I was in the Philippines and we did standard and had biometrics about a week before leaving and took all the documents back to the UK on the saturday and spent the weekend tweaking and reordering things before sending off on Monday.

Think with priority documents are supposed to be there within 10 days and with standard within 20 days.

    Thanks @Br28016

So my wife and step daughter could do the biometrics here in Manila, while I'm in UK and when biometrics are complete, I can send the docs to Sheffield? Will I not need to print off an application reference number etc to accompany the package?

    Thanks

    Dave

You get the reference number as part of the application process eg GWF1234567. So you will know the number to quote in the documents. If you started the on line application using a shared account may know the number already.

Need to print off the application form and send a copy of this as well but can get the application form from the visa submission On-line - download as pdf file to print it. Only thing do not have is a signed version but since process involves taking the application form and signing it at VFS dont think that should be an issue. As I was in the Philippines at VFS as well I got wife to sign version that we sent with the documents.

As my wife and stepchildren were here for six months we could do a lot of preparation here including English test. Had to return to philippines to get tb test and do application. Picked up a few things there to include but if had tb test and been in UK then could potentially have sent back at same time as biometric.

    Thanks @Br28016

I think I will stay here in Manila until the biometrics are done and then I will fly home (start the job hunt etc) and post the evidence/documents to Sheffield. My wife and step daughter will have to stay around Manila and await the decision before flying to UK (hopefully!)
