Spouse visa settlement decison has been made

    On the subject of employer letters my view would be this.
    The UKBA will see the employer (the payer of the wage) as the source of income.
    Most companies if not all are registered at company house and are vat registered. This will mitigate the risk of it being Mr Chans sweatshop dodgy dodgywink wink in some underneath the arches.
    Therefore it is an auditable track of the applicants income. Further it gives the UKBA a check point of contact should it be required. The UKBA like most civil depatments like to see full circles
    Wage payer,wage reciever, tax payer,wage payer and so on.

    Thanks for that, @AM2018. It just defies logic that some applicants are given the opportunity to submit extra/missing evidence BEFORE a final decision is made, whereas others just receive a straightforward Refusal and have to submit a fresh application to address the missing evidence!

    The ECO before issuing a refusal on missing information will decide if the missing information would be enough to reverse a refusal or are there other negitives driving the refusal.

    The bottom line is its better to tick as many boxes as possible and assume nothing. I used a consultant and I havent seen anything mentioned we did not include. I think of it as taking away any excuse to refuse the visa rather than hoping there is enough documents to convince the decision maker.

    Not many, just 25 days but I am not sure what Priority Service means.

    Mica's visa for the Cayman ran out on Saturday though. She has no visa and no passport

    :eek: hope you get the result before Saturday. I'm not sure but working visas usually have 30 days grace period to renew.

    Agreed - that's what should happen, according to the UKVI guidelines. In reality, it's not happening in all cases...

    As long as she does not work she will be okay I think. Phil need visa to stay in Cayman but immigration are not exactly terrible. The main problem is disgruntled local employees who report their companies to immigration.

    Did she talk to her employer already about not renewing?

    It cannot be renewed without a passport anyway and the visa would be minumum 6 months. Mica is leaving as soon as she has the visa.

    No, its a bit of a joke really. They had a crackdown in 2010. Soemone had overstayed 12 years. Mostly the businesses employing them get fined but the people are allowed to leave without conviction. The Island prefers to issue administritive fines, assuming people leave voluntarily, that do not prevent the person returning to the Island. As long as Mica goes to immigration before she leaves, when she has her passport back, she will be fine.

    Mica went to the Cayman Immigration office today and they gave her a 14 day visitor visa so she is legal at least. We will need to go back if no result in two weeks.

    That's good. Wont stain her record for overstaying.

    Did they give her a document/letter visa? Good thing she was able to get a visitor visa without her passport.

    Yes they did, she goes back with her passport later. The Cayman do not send over stayers to court so there is not usually a record. Just an "admin fee". If you don;t get sorted neforehand though they can arrest you at the airport, you miss the flight, then pay the fee, rebook the flight, then leave

    It will be interesting to see if they meet the '... 30 days from biometrics' date quoted for Priority applications!

    Well it went from promising to disaster. Mica has been asked to resubmit her biometrics. The next available date is the 16th August. That means that we will miss the two month appointment with the Manchester Registraar for the October wedding. she now has no job, no visa and no passport.
