We got child dependent visa

    Finally after nearly one year Ayen and I are happy to announce our daughter has been granted the Child Dependent Settlement Visa, it been a long journey but our second application was successful below are the documents we used to make the application, I would like to thank all those on this forum who have given help support and encouragement to us through this torturous process A BIG THANK YOU, below the list to help others.

    1. Child's Documents (Applicant)
    a. Original Passport (Submitted in Philippines)
    b. Original Birth Certificate
    c. 2 Passport size photos
    d. Original TB Test Certificate
    e. Schooling Certificate, Barangay Certificate (Local Council) as proof of residency in Philippines
    f. Affidavit from the child, the mother, and two witnesses
    g. Affidavit and Affidavit of Consent from Biological Father with Passport Copy and Seafarer’s certificate with contact address
    h. Affidavit of Guardianship Grandmother

    2. My Documents (Sponsor)
    a. Certified copy of British Passport
    b. Birth Certificate
    c. Addendum to Tenancy agreement proof of address
    d. Previous 8 months’ original bank statements showing UK based earnings
    e. Previous 7 months’ payslips from UK Employer
    f. P60 End of Year Certificate
    g. Council tax letter, including wife name
    h. Water Utility Bill, including wife name
    i. Employment Offer Letter from employer
    j. Annual Pay Review from employer
    k. Disclosure Scotland ID Declaration Form, passport and driving license Signed by company Manager
    l. Divorce Decree Absolute with Translation

    3. Proof of Relationship:
    a. Previous 8 months’ original bank statements international account showing payments to wife account Philippines as maintenance
    b. Letter from wife mother of child stating sole care and responsibility and confirming will bring child up as a good Catholic and be responsible for child in the UK
    c. Letter from grandmother of child, confirming child was in her care while mother away, and child is a good Catholic
    d. 2GO Express receipt from VFS Global
    e. Marriage Certificate
    f. Barangay Certificates Mother (Local Council) as proof of residency in Philippines with the Applicant Child.
    g. Pictures together as a couple/family
    h. Facebook Chat logs print out Sponsor with Child
    i. Receipts payments made in Philippines sent via messenger from grandmother to mother including dental treatment
    j. Copies of Flight tickets hotel bookings etc.

    4. Additional
    a. Copy of new Philippine family law article 176 February 24 2004
    b. Copy of old Philippine family law article 176 July 17 1987
    c. Passport copy grandmother
    d. Mother certified passport copy bio-metric page and entry clearance page
    e. Mother certified Bio-metric Residence Permit
    f. Mother certified Provisional UK Driving License
    g. Mother Original Birth Certificate

    5. Application
    a. IHS Reference Email and Payment Email confirmation
    b. Sponsorship Declaration Form
    c. Priority Service Bar-code
    d. Appendix VAF4A

    congratulations !

    so it seems there is no rhyme or reason to UKVI decision making. did the childs father have no responsibilities towards the child ? was he on the childs birth certificate ?

    i ask this because we were refused a child application earlier this year--as were others.

    @bigmac The child's biological father was named on the birth certificate, wife never married before, he has never had any responsibility for the child, but did see her a few times when he had shore leave (every two years), he never paid any maintenance. He stated all this on his affidavit (which I wrote for a lawyer in the Philippines to print and him sign) also in the affidavit he confirmed the Philippine family law article 176 February 24 2004 and he agreed with it.

    @bigmac we did not provide sufficient evidence of sole custody and sole responsibility, just provide an affidavit from Ayen saying she was responsible for her daughter. The immigration advisor we hired at considerable cost, even after I told him it would be a problem did not insist we got better evidence.

    did you use an immigration lawyer for the second application ?

    No did it ourselves the guy or company we used first application was not a lawyer they were immigration advisors, I did not realise there are 3 levels of government registered immigration people level 1 are just advisors they have no legal standing, but they charge the same as lawyers. Wish I had realised that at the beginning. So anyway for the second application we did it we knew what we could do and tried it, we did not try to get a court order, just affidavit from the biological father.

    c. Addendum to Tenancy agreement proof of address

    h. Water Utility Bill, including wife name

    Those seemed to be enough. I did not state size of the house or number of rooms, but I have seen other people who have given those details especially if there are many living in the house, we are only 3.

    @Rephidim10 it should be 2.5 years but don't know until we pick up the biometric residency card which will have the exact date on it

    Thank you for this! Very helpful! I’m also kickstarting again my sons application. Similar situation but we was married and been annulled as well. Now my son is 16 and his dad stop seeing him when he was about 3 years old so it’s always been me and my parents who supported my son. I’m quite stuck with the special power of attorney at the moment as my moms taking my son here instead of Me.

    Hi got a solicitor in the Philippines to write them then got signatures from all including witness of signatures.
