A letter from council

    Sorry bout keep going on about this, as this is only thing i am worried about when doing my wife visa, just want to ask if anyone here has moved their wife and son in without letter from council, i have letter from them saying if they move in my flat could become crowded, i have had a ukba report done and they said the flat is big enough for 3 people. The council are not looking at the housing act 1985 and just counting me have 1 bedroom but the housing act 1985 count how many rooms are able to sleep in, such as 1 bedroom and 1 living room. i have tenancy agreement and rent book and ukba report and was going to write her an invitation letter but worried that might not be enough, as no letter from council saying they can live here, thanks for any replies.

    I didn't have a letter from the Council; I just sent in a floor plan of the house; that worked OK

    Can i ask, did you not get letter from council, saying your wife and son can move in with you, i only ask, has thought the council are our landlords, thanks for your reply.

    I believe you do need a letter from the council saying that they are able to live there. I would imagine so long as you have a housing report that states clearly the property satisfied the requirements of the act then you will have no worries. The council letter merely contains an opinion no more. I wouldn't worry.

    I agree with John, you have the survey (UKBA approved) to satisfy the UKVI so I wouldn't worry about the council.

    Hate to say it, but I'm pretty sure you'll need a letter from the council saying that your wife can live there.

    They are your landlord, and you need a landlord letter.

    Its a good point, if the council is your landlord then you need a letter from them confirming the missus can reside there as part of the visa application.

    @deanobean needs to work on that to be sure there are no problems in that department, I don't understand why the survey people are stating that the accommodation is fine and the council are not.

    I told the council that and they said they not need please the immigration rules, just what their policy is and they not count living rooms has sleeping area, just count the bedrooms, has i am on pip i was going on the adquate maintance rules and they give an example has a 1 bedroom flat is good enough for 3 people but the council not bothered about that, thanks for all your replies has they are very helpful, i will not give up, has 1 day i will get my wife here even if it kills me.

    Where there's a will there's a way, what about if you brought the missus to the UK first leaving the youngster with family, got her settled and working then move into a two bedroomed flat using the extra money from the wife's income? We both know that a one bedroomed flat is really too small for a family of three, everyone needs a little privacy.

    My wife could never settle without our son and to be honest i would not too, i will just see what happens with the council and then decide where to take it next, thanks Timmers for your reply has always helps me.

    I can fully understand that your wife does not want to be separated from her son, either the council or yourself is going to have to compromise somewhere down the line.

    Thanks Timmers, i not going to apply till end of may, so will be having long chats with the council and sort something out, just seems everytime i take 1 step forward i get hit and take 3 steps back.

    Keep pestering them, they might get fed up and give you what you want, if at all possible though I would be giving a lot of thought to a plan B.

    I think this is important and I wouldn't go ahead with visa applications without the letter from the council.
    Is it really worth taking a risk spending so much money to be possibly refused because of a missing document?

    Thanks for the replies, i have decided to ask the council to do an immigration home inspection, has i only asked a housing officer for letter asking for my wife and son to live here, has i had already had a ukba inspection, hopefully when they come to the flat and measure it, they might give me a letter saying its big enough, i will keep you informed.

    Make sure you show the council your paperwork from the UKBA survey you had done, it may sway them.

    Yes i will. just wonder if its enough, if they pass it, will i still need get that letter from housing officer who refused me before.

    only 1 way to find out--as stated already--you cant risk that visa fee with a small but very important document like that.
    explain your situation carefully so they realise the importance of the letter.

    Thanks for all the replies, has helps me alot, i have booked it now and will call me back for date,i asked them if they pass it, do i still letter from housing officer saying they can live here and he said yes but they will re-look at what they said and should change their letter and say they can live here. Sorry for keep asking but thought i would do it here in-case someone later has the same problems and this will help them.
