Applying EEA Family Permit for wife and 2 months old daughter

    Just a very quick question. I am helping a friend. He's an Irish and he did all the paperworks for his wife.

    He filled in his wife's application and included their 2 months old daughTer in his wife's. Is he doing the right thing? Does he need to make two applications or just one?

    But he already renounced his British Citizenship....so he is solely Irish now.

    My answer below relates to the United Kingdom. And I've just read your above where you state he is irish. I am confused though where you state he is Irish but from Northern Ireland.
    I would expect an Irish Citizen to be from Southern Ireland. I would expect a UK citizen to be from northern Ireland.

    It is possible for an Irish passport holder to reside in the UK under EU free movement rules (currently) though.

    I think you need to find out whether he holds a United Kingdom passport. Or an Irish Passport. And where (northern Ireland or southern Ireland ) he lives because this has a bearing on the sort of application he will be making and to which government.

    Assuming that he lives in Northen Ireland - For the United Kingdom of Great Britain and Northern Ireland the answer would be.

    You need two completely separate applications. One for the child and one for the wife. Each application must have a complete set of paperwork and supporting documentation and be submitted with a copy as usual.

    Of course, the child will be mentioned on the mothers form as being a dependent, and the mother will be mentioned in the child's paperwork as being the parent.

    But you need two online applications. Two Visa fees. Two IHS payments. Each application must be able to 'stand alone'. You can't apply for two people on one application.

    Thank you for this. So that means he has to make two applications if he apply for a family permit then?.


    By the way, sorry for the confusion, he holds two passports, he is a dual citizen. He renounced his British Citizenship recently and retained his Irish passport. At the moment he is solely an Irish citizen.

    If he has renounced his British citizenship then he is not dual citizen and his British Passport will have been cancelled. He will need to apply for a Family Permit through the British Embassy if he's abroad or direct from the Home Office if he's in the UK.

    Yes he was a dual citizen in the past. But he is now solely an Irish citizen after he renounced the other one. His wife will be applying in Manila from Cebu. She just flew recently and will stay there for few weeks.

    I'm just concerned because they only made one application and just included the baby in it.

    Pat we havnt ever applied for an FP so Im not 100% sure with an application in the UK for a residence card they all can go on one form or none since forms are NOT compulsory in EU applications a simple letter is enough . The second point is that as they are married and the father is on the birth certificate the child is also an EU Citizen (irish ) and as such it could be agued has an automatic right to come to Europe It is of course free to apply and no health surcharge is required If it were me I would await the outcome since if the application is incorrect they should state this immediatly
