    at the end of the day--the lady has got to apply for ILR--so she has to make sure her application abides by the rules. if she is working full time i'm sure the inland revenue are aware of it---but if her husband has failed to declare her earnings to the local council---best get that put right ASAP---if he is claiming housing or council tax benefit.

    It's child tax benefit. It's not the same.

    There is a possibility that he might be getting too much, though, which should be looked at.

    One of the problems with the five year route is that a lot of things can change in your life in that time, not always for the best, I don't think you can breath a sigh of relief until then.

    old rules ended in july 2012. settlement period was--2 years wasnt it ?

    You're our resident mathematician bigmac, you tell me :)

    Which ever way you look at it, the old rules stopped in 2012 so anyone entering the UK in 2012 will have the visa hurdle behind them, maybe someone will tell us a reason why this may not be the case.

    Yes 2 years and a month or so. But pretty much 2 years. My wife was awarded ILR after just over 2 years.

    Hang on. Didnt the new rules come in July 2013?

    Nope. It was July 2012.

    Could it be that when you apply by post at the end of the two years that it can take a few months?

    so--to summarise

    hubby isnt working--but claiming some benefits--which he would rather not lose--so he omits to tell the council his wife is working full time--whilst bringing up a 1 year old. (also doesnt seem too interested in his wifes visa )

    she hasnt yet applied for ILR--which i think she should have last july--?

    i can just imagine our friend micawber clasping his hand over his eyes.
