Best way to return to uk with my newborn son from the philippines....

    My son was born in philippines and im from the uk as he has right to duel citezenship im not sure to get uk passport or philippine passport plus visa to take him to the uk.Ihave been told i will inccur charges from immigration at the aiport if he got uk passport for every day he in philippines. Is this true and whats the costs perday

    Hi thats a new question a bit more of your story would be useful please include where you were born, what your status is in the phils and wheres mum in the story.

    Is your name in your boys birth certificate?

    Hi.
    I am from scotland and born in the uk i meet my partner while in brunie working. My partner and i have been together now 3years. As i work offshore all over the world i just return to the philippines for a month and work a month so no need for a visa to stay in fills. Our son was born 2months ago and due to the typhoon they went missing for five days. I found them safe and well but want to take them home to the uk. I am on the birth cert, we have NSO which was a nightmare as all paperwork was lost in tacloban cival office so had to do the process all our self in manila. My partner can get a visit visa to uk in 15days as we have all her paperwork in place this will give her a 6month vist and we can marry in uk and apply for settlement visa for her so no need to return to philippines. This is our information from the visa office in manila. But i have to wait atleast 3months for a visa for my son if we apply for philippine passport.but if i apply british passport it only take 15 days from hong kong but been told i might inccur visa chrges from immigration as they class it as visa avoidance and he not fly till it paid???

    If I were you I'd definitely register him as a UK Citizen. A UK passport has more opportunities than a Philippines one, and you may have to apply for a visa if he doesn't have one.

    Be careful about marrying on a visit visa and applying to stay. I'm not sure, but you may find you can't do that and have to reapply after she goes back to Philippines.

    I was assured that she can apply for a visa of marrage classed as visit visa. That was the guidance we recive today in manila

    For you to get your son a British Passport you must first register his birth with the British Embassy in Manila and obtain a Consular Record of Birth which is equivalent to the British Birth Certificate. Once you have this, you can apply for his Passport - do note that you will NOT be able to get him a British Passport either here in the Philippines or in the UK without the Consular Certificate.

    There is no problem with him also having a Philippine Passport which you use to leave the country: that will take 2 - 3 weeks to obtain, depending on where you apply.

    Your partner can NOT marry you on a Visitors Visa and then apply for a settlement visa in the UK. Whoever told you that gave you incorrect information. If you want to get married in the UK then she needs to apply for a Fiancée Visa or, if you marry here, then she applies for a Settlement Visa here.

    Exactly WHO gave you this information? It is totally wrong.

    I was at the Vfs office today in manila and said we can use family or vist visa application which i have infront of me

    From UKBA website about family visit visa: http://www.ukba.homeoffice.gov.uk/visas-immigration/visiting/family/requirements/

    You must be able to show that, during your visit, you do not intend to:

    live in the UK for extended periods through frequent or successive visits;
    take paid or unpaid employment, produce goods or provide services; including the selling of goods or services directly to members of the public;
    do a course of study; as long as this study is not the main reason for your visit (see 'permitted study' below);
    marry or register a civil partnership, or give notice of marriage or civil partnership;
    carry out the activities of a business visitor, a sports visitor or an entertainer visitor; or
    receive private medical treatment.

    295A. The requirements to be met by a person seeking leave to enter the United Kingdom with a view to settlement as the unmarried or same-sex partner of a person present and settled in the United Kingdom or being admitted on the same occasion for settlement, are that:

    (i) (a)(i) the applicant is the unmarried or same-sex partner of a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement and the parties have been living together in a relationship akin to marriage or civil partnership which has subsisted for two years or more; and

    __ __(ii) the applicant provides an original English language test certificate in speaking and listening from an English language test provider approved by the Secretary of State for these purposes,

    There is more you might want to consider. Marrying in the Phils might be a good option you need to meet the financial requirements £18.600 a year earnings

    Yeah i have read that too but thats the info they gave me. I will look into it further what they advised.I will go back to make sure it true as i dont need anymore hassel its a nightmare here in manila to get the right info and assistance.up to now its cost us £750 just for NSO birth certs for my son. We got the run around from NSO office. Half of them dont know what they are talking about or there job unless you go to the top as we did. It took 3hours and it was in my hands its has took us three weeks to get from office to office. Thats why i was hoping somone in same situation or knows the script.

    Yeah my partner has done the english exam already and passed with no issues. And i have a good paying job as im selfemployed engineer offshore. The issues i have right now are we are in the provence and due to lack of food water after the typhoon the NPA ie terrorists are going around the village looking for food and money and im a target for them and we cant vist family here in case we put them at risk. Ive been in touch with the embassy and the FA and the commonwealth but there intrests are all for people in the area of tacloban as its been made the media spotlight and everyone else has been brushed aside. People here in the south leyte area havnt got any support or very very little and suffered in the same way but thats another story.

    ^ I have a family visit visa and as stated, one can't get marry in the UK using that visa. Your partner should have a fiance visa to be able to do so.

    Also, why did you have to pay 750 for a birth certificate? It's pretty easy, you can order it online for less than 500php and it gets delivered to you.

    And VSF is outsourced by the British Embassy and other embassies to handle the data collection for visa applications. I wouldn't really trust them 100%. I suggest you go to the consular section of the British Embassy in the Fort to consult your situation.

    Its easier to offer suggestions the more we know of your story so far my reconing is it will be easier for you to get married asap in the Phils and crack on with the uk passport for your son if you work offshore and it doesnt really matter where you "live" you could when married get a free & quick entry visa to Holland or Eire (or any other european country that suits you)as a european exersizing your rights of free movement with your spouse without all the onerous B.S. the H.O. give you from these countries you could apply when it suits you under normal rules or explore the euro rules if your employment contract can be made from a euro country

    Well i have done some searching the last two days and found out that if i get uk passport i only have to pay for a exit fee of 500php to the immigration office plus a charge to the value of 20,000 php this isf or days he stay here which covers him upto one year whithout any more charges.This charge starts after one month after birth.For my partner she needs a fiance visa as we thought. I also found out that as from yesterday the HongKong office will not be granting passports or visas for uk citizens it will all be done from liverpool now via online. I would like to thank all of you for your help and advice and if i can assist anyone in same situation please drop me a pm or email as i know its a nightmare. I have names of offices and the people you need to contact. Once again big thankyou. Ps will let you know how the exit goes thanks.

    If your son has a filipino birth certificate then I can see no reason why you should pay anything he is only exiting on the day and should pay the foriegn travel tax but while he lives in the Fils he is a filipino with joint nationality the fact that he doesnt hold a fils passport cant ,in my view affect his status i think its worth checking further perhaps with the D.F.A. direct perhaps someone sees a cash opportunity

    I suspect this gentleman is relying on and paying "fixers" who are deliberately supplying him with incorrect information and charging him exorbitant amounts of money.

    The British Embassy no longer issues Passports but merely passes all applications to the Passport Office in Liverpool where they are issued. The Passport Office requires proof of citizenship as evidenced by a Birth Certificate and in the UK you'd send a "long style" Cerificate obtained from the Registrar of Births, Deaths and Marriages. For citizens born overseas, that Birth Certificate is not available and you'll be needing a Consular Record of Birth issued by the Embassy for the country in which the child is born. However, the Foreign Office web site has modified its wording to say that a Consular Record is not required but you will have to produce the very same documentary evidence for the Passport application as you would for the Consular Birth Certificate. I would still recommend obtaining the Consular Record of Birth as you may require it in the UK.

    Do check this out from more than one source. If I am in doubt on this type of thing I check with the UKBA / Passport Office. An email would suffice.
