Mate of mine got married recently and his missus has her spouse visa this week , her passport will expire in 2017 if she does a name change to her married name what do they have to do regarding the BRP and vingnette and what does it cost?
Her passport and her BRP must be in the same name. Changes of name on the passport will require a new BRP. Technically application for a new BRP must be made within 3 months of the passport change. Replacement BRP is £45 increased to £56 on 18 March 2016
Or Do you mean she will change her passport name before making visa application ? In which case the BRP will be made in the name on her passport at the time of application. Or Something else
the first spouse visa received a week ago her passport expires in 2017 when she applies for new passport and changes to her married name my mate is under the impression its nearly £200 to change the BRP as its befor the next spouse visa at 2.5 years
That case would be classed as Transfer of Conditions (TOC) and would indeed attract a cost of currently £183 which increases to £223 on 18 March 2016 I wouldn't want to predict the cost in 2017 ........
Ok, I'm confused here. What exactly is the difference between a replacement brp and a Transfer of conditions? My wife will get a new passport in a year or so and will do it in her married name. Her brp is in her maiden name at the moment. I'm rather hoping to just wait until ILR before updating the BRP, but obviously don't want to do that if it is risky.
A replacement BRP is just that. A duplicate of the existing one containing duplicate data including expiry. Application for a replacement BRP, when already in the UK, is usually made in cases where the existing one is damaged, lost or stolen. Application needs to be made within 3 months of requiring it or, according to UKVI, you may face a penalty fine of up to £1000 or have the permitted stay curtailed. TOC is made when it's necessary to have the immigration status and ID confirmed in a new BRP or passport. Same timescale conditions apply for application. Not from date marriage. Plenty of time to go yet I know, but just be sure to regularise ID's and have the very same name on the Filipino passport and the British Naturalisation certificate.
Interesting to see such a deliberate and disproportionate cash making exersize that would be unlawfull under european law in my view
