Child settlement

    Hi guys! Good evening.. Am just a new member on this forum. I would like to seek help in this matter. I got my British citezenship since 2009 under the work permit visa and my wife is currently waiting for her application for citezenship to be approved, she got her spouse visa since January 2012,were both happily married since 1999. We're planning to apply this November and bring over our 2 sons ages 15 and 14 next year. There both under my mom in law guardianship. The application form that I will be fiiling up is VAF4a/appendix1 & sponsorship undertaking is it correct? Can I apply for them thru online under my registered account on visa immigration website? Or do I need some immigration consultancy firm in the Philippines to assist me? Any recommendation? It would be a great deal of help. Thank you!

    In your naturalisation/citizenship forms, there's actually a question regarding children.
    If you have listed your children in there, then the Home Office will consider to grant them UK citizenship as well.
    There's no need for sponsorship since they are under 18.

    Thank you Knightstrike for the quick reply to my queries... I never thought of it. Regardless that my 2 sons are still in the Philippines and a Filipino citezn? I thought they need to have an entry clearance to come over as family of settled visa. I'll have a read on the new guidance on the application for citezenship that you send me.. Thank you and much appreciated!

    I think that generally only applies if your children are over 18.

    But since you said they are not, then they can automatically become UK citizens.

    They will be considered, 'British by descents' which will change to 'British otherwise than by descent', when they have already moved and been living in the UK for three years.

    That`s interesting because I always thought that my daughter (born in P.I) would always be considered British by decent even though she spent 8 years growing up in the U.K.
    I was advised by someone else that if she ever wants kids one day and she wants them to be British the kids would need to be born in the U.K.
    My 2 boys were both born in the U.K so they are simply British..Not by decent.
    Hopefully we can use this thread to clarify everything one way or the other.

    I've just read the guide form.. I think they still need to apply for an Entry Clearance visa in the Philippines to enter in UK, we both included their respective names in my application in 2009 and my wife application this year. And they need to be physically here in UK to apply for their citizenship and satisfy the residency for 2 years before they apply for application.

    Yes, I've read through again. They will at first be permanent residents until they satisfy the residency period.

    But they would be considered for UK citizenship... which of course they will since both of you are/will be.

    Good luck again kababayan and to the kids as well.

    My lawyer in the UK who specialises in immigration and citizenship, has ran through with me possible scenarios regarding my own status. From what I could remember, if a child born though parents who are British by descents, they could pass on their UK citizenship to their children, granted they spend three years in the UK prior to the child's birth.

    My uncle from my mother's side, also was a British by descent and dual-national (Filipino/Brit). He got his citizenship from my grandmother (long deceased), who is also dual-national, and got naturalised back in the late 70s.

    My uncle moved to the UK back in the 90s. He has also gone through two marriages. His current one, is with a Filipina. They have three kids who were all born here. One of them already has a UK passport, while the other two are waiting for theirs.

    So don't worry grandpa. You would be able to teach your future grandkids how to enjoy Marmite, Fish and Chips, and Cadbury in the UK.
