If you are in the UK as a spouse of a British Citizen, and you have stayed here in the UK for 3 years, does it mean you dont have to apply for ILR before applying for citizenship? I have read in the gov.uk website: It says only “one of the following” and I have leave to enter as well as further leave to remain already. Thank you in advance!
'(Indefinite) Leave to Enter' and 'Leave to Remain' are different things... You need to have been IN the UK FIVE YEARS (not 3) before you can apply for ILR, then British Citizenship.
you need ILR before you can apply for citizenship..but then you can apply straight away if married to a british citizen.
It says you need one of the 3 but you don't have any of them Your clearances have had and havr a period of time attached to it ie valid from and valid till date the 3 that you qoute are indefinates. ie indefinate leave to enter You have not been granted indefinate yet. Yes there are visas you can get ILR after 3 years ie Tier 1 (entrepreneurial skill set) but even this category wait 5 years for BC
I remember this from when we applied. I think the 3 years is a hangover from the time when FLR was only for 2 years. It's like a Catch 22 situation. You can apply for Citizenship after 3 years, but you need to have Indefinite Leave to Remain to apply. To apply for ILR you have to have been here 5 years. So even though it is 3 years, it becomes 5 years by default.
Quick question, what documents can you use to prove address for the BC application my wife has the ILR, I read somewhere that household bills are not proof ? I need the last three years, any idea's anyone please. Nigel
Household bills are absolutely fine, normally it’s over the last 2 years period, joint names , own names a mixture is fine, you can also use the same utilities bill twice this year and last year, community charge etc
