    am worry..does it means that if the husband receiving any benifits /public funds..it would be possible that they will denie application for my ILR..huhuhu:(:(:eek::erm:
    as currently he si receiving public funds as we got kids as well and obviously i DONT as I AM on spouse visa which am aware am not intitle while on spouse visa..any advice:erm:

    Your hubby is ok to claim any benefits he is entitled to in his own name. No problem. Just be sure that YOU do not claim any benefits you are not entitled to claim. Also that your hubby is not claiming any additional benefit by the very fact that you are there.

    There are plenty of people who were on benefits when their wife applied for spouse visa, they are still here now and they also were granted ILR and UK citizenship.

    As long as you are both able to support yourselves without recourse to public funds all is OK. In principle you need to show a weekly disposable income of£105.95 per couple plus £62.33 per each dependent child under 20 years old.

    Your ILR is not available until 2012 right?
    No need to worry too much just now.

    Does your hubby have good chances for a job soon?
    Does you hubby have family in the area that could help with accomodation? Just thinking ahead.

    my friend :0 could you explain further by your statement "recourse to public funds all is OK":erm: currently he is receiving child benefit..housing benefit.. child tax credit..does it belong to public funds? sorry for my ignorance i just so confuse..he is trying to get work but at the moment its been so hard to find:( so worry now that i am heading to application for my ILR..although we live reasonable..am just concern of how the home office will assist our financial:erm:..he got building society to show this though...and it shows there are money coming but mainly from benefits he receive..and yes i dont completely claim any benefits at all am aware of that:)

    So please ignore that one.
    Just to confirm that your hubby can claim from public funds in his name.

    It's ONLY YOU who cannot claim.

    "No Recourse to public funds" is the very famous UKBA phrase meaning:- you are prevented from using public funds as a source of help or support.

    Remember, your hubby CAN claim in his name
    You CANNOT at all.

    By the way, once you have ILR you WILL be entitled to make claims on public funds. I hope you will not need to though.

    thank you for the reply Micawber am just worry that until then he couldnt find a job and ill be applying for my ILR..would it affect??:( i hope not..his trying to find job i know..:) same as me..but no luck yet:( am anxious thinking that..that if he continue receiving public funds it will affect my application..:(..and YES am aware am not intitle to claim any benefits:)

    Balot, personally I would not worry too much right now. Both of you need to think positive and do some financial planning and job hunting.
    If your hubby has some family that could help with accomodation that could be a good fall back plan (just beware of overcrowding)

    As I mentioned before, the financial key is that you are able to support yourselves.

    It is very very rare that ILR will be refused solely on financials. That kind of decision can only be made by a Senior Executive Office.

    The worst case scenario is that both yourself and your hubby have not worked at all in the 12 months leading up to ILR application, and additionally that your hubby has been claiming benefits and additionally that your financial resources are marginal.

    Various Immigration Tribunal's have concluded that it would not be appropriate to have immigrant families existing on resources that were less than the 'Income Support Level' for a British family of the same size. This is probably the best guide available for marginal finances.

    As I mentioned the level PER WEEK is:-
    Couple - both 18 or over................... 105.95
    Each dependent Child - up to 20 ....... 62.33

    After payments of mortgage/rent etc

    If anyone found themselves in these conditions and the ILR was refused then of course an appeal would be made.
