    Hello everyone, so yeah life happens and now I'm seeking advice on how long it is to get a divorce in Wakefield England?

    How longdoes anyone here has an idea on how long to get an absolute decree from marriage?
    This is a lot of hard work, after getting this divorce I still have to get a recognition of divorce here in my country philippines.

    it takes 6 weeks from decree nisi to d. absolute--if its simple--unopposed and. straightforward. but it wont be recognised in the philis---unless he divorces you--if hes a " foreigner" under phili law.

    Oh thank you Big mac that is faster than I expected, I thought it will take 6 months to one year before absolute divorce decree will be released.

    Yes that is true, we don't have divorce here in philippines but we have law that will recognize the divorce made by the foreign spouse outside the country, I will need to file for Recognition of Foreign Divorce, that will take a bit time cause Phil always try to make all things complicated.

    no--your "foreign" husband has to divorce you----him being the plaintiff---you the respondant----in order to be recognised in the philippines.

    by " foreign"---i mean he is not a philippino.

    Yes my husband is British he will file for the divorce in England, and yes I'll be the respondent, when the absolute divorce decree is released I'll have to file a recognition of foreign divorce here in philippines so I'll be back to being single. Ouch long hard process. Tired. Plus the emotional damage

    sorry things didnt work out for you. i went through a quickie divorce--finalised 2 years ago--ending a very short lived marriage. but thats the beauty of UK divorce--if both are agreed it can all be over quickly--clean cut and relatively cheaply.

    No, really important the guy has to divorce you under Philippine law, you cannot divorce him or it will not be recognised, very very important point.

    My partner was previously married in 1995 to a Korean guy, In Korea all divorce is treated as being consensual, in other words both people agreed to the divorce, that is actually recognised in the Philippine but it is not easy, and even after 21 years since her divorce, me and my partner are basically unable to marry, because we are one paper short of what the Philippines requires from us, she has that now but we are still unlikely to marry now after so long.

    Excellent yes that is exactly what you need to do.

    I am very sorry that things had come to that circumstance for you and for your husband.

    However the recognition process itself is a simple administrative procedure but you need to make sure you have all the documents in English and without errors and they have to be submitted properly in the Philippines, you know what your Philippine bureaucracy is like :)

    That means you need all your proper historic documents of the marriage and so on, if you have everything then it should be fairly simple.

    @bigmac hiya I'm still here in philippines, we both agreed to ahve a divorce in England, he will be the one to file the divorce, honestly I don't want to ahve the divorce as much as possible I want us to work out the marriage but he doesn't want to, so have no choice but to say yes.
    I'm interested about this ' Quickie Divorce ' how fast did it go @bigmac? How much does it cost and will it be available to my situation that I'm still here in Phil? We have a short relationship as husband and wife.

    @oss Aww it's sad to hear that until now you and you're partner can't still get married, I hope her documents will be sorted so you ypu can be together.

    With the Recognition of Foreign Divorce, really it will be just a quick administrative process? That made me smile cause I read an article saying it might take 6-12 months.

    Yes I am complete with historic documents of marriage.
    It still makes me feel sad thinking about the divorce. .this is not what we expect...it seems that he gave up easily.

    What is the percentage of people getting divorce in England?

    Getting your divorce recognised here in the Philippines is pretty much an administrative exercise although it will require a court hearing and a judge's ruling before the NSO will even consider processing it. Like everything else here, it will cost.

    Are you in the UK right now and will be there for the divorce court hearing - and, importantly, are you being represented by a Solicitor who is well-versed on divorce law? If you're not represented at all, the judge may decide not to proceed until you are represented and that a financial settlement has been agreed. Following the Woolf reforms, Judges usually require an even division of assets as a starting point, meaning that your ex-husband will have to agree a financial settlement with you. You do need a lawyer to help you with this.

    Hi @Markham I'm still in here in the Philippines, we are in the middle of my spouse visa application when he decided to cancel it and thunk of the divorce instead.
    Are we going to get divorced even if I'm here in the philippines?
    I mean proper divorce?

    Yes I'm aware that the Recognition of Foreign Divorce will be costly I need to get lawyers to represent myself in court.
    one of my concerns is how long will philippines be processing that Recongnition of foreign divorce?

    Yes but the court will require evidence that you know about and agree to the divorce proceedings and notification as to whether you are contesting the divorce.

    Like many things here, that depends on where you live and how amenable the judge is to grant the recognition.

    it depends if you are going to agree over property/ money. also--what grounds are you using ? and--how long have you been married ?

    Hi everyone, we don't have money or property to be divided. We been married just for 3 months and I'm still in Philippines.

    He doesn't want to spend for the divorce He doesn't have money he said but I know he does, he said I should pay for the divorce or else I'll wait 5 years so he'll divorce me. What should I do? I want to get a divorce, how much will it cost in philippine money?

    I thought you'd got over wanting a divorce and were going for a spouse visa again I can't keep up with you two!

    Part of the divorce process would involve him declaring his finances.
