E-Tickets issued without payment?

    Hi,
    I was looking online at a travel agent and chose an itinerary to go the Phils.
    When I came to pay they could not take my payment online and took me to a web page saying "Oops, we will refund you £5 per person if you see this page...."
    I spoke with a salesman there who told me they were having IT problems and he also said he was new and wasn't sure what he was doing.
    Later that day four e-tickets were sent to me even though I had not paid for them.
    The travel agent then sent two links on two further days to get to their payment page but I was still unable to access these as the links were "invalid.

    Since then I keep getting phoned by them asking me to pay.

    In the meantime, as they seemed to be disorganized, I saw better offers elsewhere and I decided we would like two nights stopover in Hong Kong instead of one.

    I spoke to the same travel agent and told them this but they said I would still have to pay for the already issued e-tickets!

    I told them they could not take my payment and I now wanted two nights stopover.

    I have looked online with other travel agents and saw better offers.
    I don't understand why the e-tickets were issued without payment and through no fault of mine.
    What can I do?

    Mike, if you get no luck from here, try the MoneySavingExpert forum, they are quite good at answering questions like this.

    Until you have made a payment or agreed terms on a buy now pay later, you are not bound to buy anything!

    UK distance selling regulations could help in this case. http://www.legislation.gov.uk/uksi/2000/2334/contents/made I do not know where you are located but you may get some pointers to help if not UK .

    Strictly under Law you do not have a contract with the Agent or Airline as you have not paid = "Offer and acceptance".

    Your payment is your acceptance of their offer = a Flight.

    They are "flying a Kite" - Pun intended. :D


    An aside - Took Tex to DISNEY HK - well she is young :angel: AND I enjoyed the experience as much as Cristina did. "Second childhood" she said.! :amen:

    Thanks for the replies everyone.

    Well things turned out really well in the end :vhappy:

    I had given up and started looking at other flights but noticed that the prices everywhere had gone up again by approx £150 per adult.
    Right out of the blue, www.budgetair.co.uk phoned me to offer £50 per person discount because the tickets were issued.
    So, we paid £1802 for 2 adults, 1 child and 1 infant LHR (Heathrow) - HKG (Hong Kong) - CEB (Cebu) with a stopover in HKG on the way out (£85 hotel room included).
    Great outcome in the end as our daughter will be more than 2 years old when we fly and she is almost full price too.

    Nice.. Now because they couldn't force you into taking the tickets they were stuck with either giving a discount or changing the name on them (assuming they could resell them) and that would have cost them as much as the discount.

    Better to sell cheap than not at all!

    I did think about stretching the discount further but was happy enough with the reduction.

    Yes Pete....we have bought a baby carrier backpack for Gregg (8 mths) so I can no longer carry my scuba kit. Ah, the changes that kids bring :erm: :D
    I can't wait to take both kids down to the sea to watch them get excited by the waves.
