Hi guys, just for a change, I'm asking a question :)

Elsa works at a care home as a senior carer and has NVQ3 in Elderly care. Elsa's employer thinks she is brilliant, a real asset to the home, and want more Filipinos to work there. So, basically my question is, how would her employer go about applying for the appropriate work permit for Elsa's sister? My first train of thought would be an employer sponsored working permit, but what would be the chances of success as its only a carer job? I know they keep chopping and changing the requirements. Thanks on advance!

    The chances are virtually zero.

All prospective employers of non-EEA workers must first secure the appropriate Sponsor Licence by making an online application to UKBA

If the employer meets the organisational criteria and Sponsor Licence is granted then they may begin a process to secure employees in line with the UK requirement.
That UK requirement is detailed in the MAC report: Shortage Occupation Lists for the UK

See also this UKBA webpage - Points-based system: guidance for sponsors

The link posted above in Andrew's post is primarily the PBS requirements for the visa applicants themselves and not the Employer

Part of the process is that the applicant MUST satisy the PBS requirements for visa application, but additionally MUST also have a job offer from a certified and licenced sponsor who is willing to be sponsor

More Sponsor information here - Sponsorship - General

If you follow the detail of the links I've provided you'll notice that the employer MUST only accept specific qualifications for specific jobs AND must be prepared to pay the rates specified.
These rates are in advance of the same rates for UK qualified staff.

Whe my wife first became a carer she was working with others on Work-Permit who were earning a few pounds per hour more than she was simply because of the UKBA contractual requirements. Once generally known it did cause a few ripples with the Brits and Europeans.

Thank you both, much appreciated. Looks like a bit of a non-starter.
