Hi all currently applying our fiancee visa and son under 2yrs. I'm British, she's Filipina fiancee and son born in the philippines Confused about the route. Do we apply the same VAF4 form for my fiancee and another for our son. Or there's another form for him, right to abode VAF7. Thanks
If the son is yours but not born in the UK then he's not automatically British. I'm not sure whether you apply for him using the standard route (as If he was just her son alone) or there is another way. I think some others on the forum have experience of that though like perhaps @oss.
That is not actually true, if the child has a British father and is not born in the UK then the child is automatically British, the only issue that ever comes up is where our authorities have cause to doubt the paternity. Recent posts on threads here have shown that people are now getting Right of Abode certificates for their children's passports with significantly less hassle than I had getting my daughters first UK passport. Let me be more clear. A person is a full british citizen if one of the parents is british where the child is born in the UK after that date in 2006. Howevr, in the event that the child is born abroad, under these circumstances, the person becomes a british citizen 'by descent' which means that they are not able to pass their citizenship onto their children automatically. This isn't exactly the same as a full british citizen.

Yeah but that is not a problem for most of us, it only means that children born to a 'British citizen by descent' are only British if they are born in the UK.
fiancee here.we already applied online using the vaf4 for both of us. and will be submitting appendix 2. son required to pay ihs surcharge and brp collection point. appointment is on tuesday. submitting our son's prenatal scans, photos of us before we had him, during pregnancy( 3 months and full term) and delivery.
yes we used the priority service. was hesitant at first coz son and i was refused a visit visa last sept. we took the risk and glad it worked for us.
son was not given an ROA just the normal dependent visa. im confused with the letter attached. Says his visa letter valid from feb 15 to nov 15 2018. also visa only valid for 30 days so must travel to the uk within that period. visa sticker says visa valid from march 15 to sept. 15.2016. brp can be collected from feb 22,2016. so many different dates. Confused on when to travel. should be within 30 days of issue and visa is valid almost a month later.
If it's a spouse visa you need to travel to the UK and enter within 30 days of issue. The when you arrive you pick up the Brp from wherever they tell you (usually your local post office)
but my fiance visa only valid from march 15. and my two yr old son can only travel with me on that date. is it still possible? we didnt see this coming when we chose the intended date of travel.
It's possible the letter is a misprint. The entry clearance sticker in the passport has a 'start date' on it. That date should match the date you put on your intended date of travel which you said is March 15th. Assuming the entry clearance says it is valid from March 15th, you have 30 days from that date to enter the UK and then collect your BRP. You can only get a CFO sticker in your passport from the 'start date' of the visa sticker in anycase (March 15th). I would just double-check the dates on everything and plan from there. If you're in any doubt, you can always contact UKVI I suppose and ask for assistance. It's kind of strange that you have different dates in your letter and your entry clearance. Are you sure you're not misreading it?
