Financials FLR(M)

    Hi,
    We are some time away from doing FLR but I just wanted to clarify the financials. If me and the missus are lucky enough to have a child prior to FLR, the child would not be part of the financial requirements, right? I know the child would be a British by default but just wanted to confirm that they would not come under the sponsor requirement.

    Hi there.

    My wife has just been through ILR and we asked the same question. And the answer was no. A child born in the UK doesn't count as part of the ILR application. I am guessing the same would apply with FLR, though am not 100% certain. See what someone else says. I don't recall it applying in the case of the Spouse visa either.

    In actual fact we included our babies birth certificate in the ILR application, even though they didnt ask for it, to make a stronger case for not sending the babies mother home, if you see what I mean.

    ( My wife came in on a Spouse visa initially so we never did go through FLR. )

    Hi John and thanks for the feedback. It's all hypothetical at this moment in time but I'm curious to know nonetheless. Yea the way I understand it is that the child would be British so they don't technically need to be sponsored (unless someone disagrees?). I totally understand if they are a child not born in the UK that sponsorship would be required. My wife also came in on Spousal visa but FLR is now part of the requirements along with the financials (9th July 2012 rules).

    I see, yes, under the new rules. We managed to avoid that, thankfully.

    Yep, sponsorship does not apply to the babies born as British citizens.

    Up until we got ILR I was always of a mindset that us having a baby in Britain would help our case and I still beleive it to be true. Its just that it doesn't appear in any blurb anywhere. I just think that the UKBA would be reluctant to send the mother back to the Philippines for all the obvious reasons.

    Someone I know was listening to a radio program or part of one, on this very topic and the message was clearly just that.

    Thanks for the clarification. Yea I'd like to think that they would genuinely consider such circumstances. Would seem extremely harsh If someone goes through all the processes of legitimately trying to obtain a visa then to be sent back, especially after being in the position of having additional member(s) to the family. I mean for the childs/childrens sake it just wouldn't be right.

    NO! your child is not included on her application, as your child will be automatically British. If one parent is British, their children who are born inside or outside UK are entitled to have British passport. Both my children are born outside UK, they are both British passport holder since birth. Your query only applies if both parents are Filipino or any other nationalities.
