    Hi everybody. Im new in the site, a friend suggest about the site.:). Im married to an Irish/British from Northern Ireland. Im still here in the Phils. In the future, I probably want to ask about visa. Im hoping I will know something informative and helpful. Thanks again, hope to make friends also.:):):):)

    Hi jing, it's nice to welcome you here to the forum.

    We will all try and help you as much as we can.

    My initial suggestion would be to have a chat with your hubby and see if there is any way to make the spouse visa application sooner rather than later.
    There are some proposed changes possible for settlement visa's to come around the middle of 2012.
    I would expect increases in the already expensive visa fees too.

    In the meantime please take a look here for some information about spouse visa applications.

    Feel free to ask anything you're not sure about.

    Hello again.Thanks for the warm and friendly welcome. We will try to apply for EEA family permit. What do u think our chances of getting a visa nowadays? We will would like to submit early next year, as we are on the process of collecting documents that we will submit. My husband has a permanent work. Worked in France, way back in the 1990's. and back for good in Northern Ireland.

    Hi jing,
    If your husband is an Irish/British National living and working in Northern Ireland, then it's a little bit unknown if an EEA family permit would be issued.

    The European Court of Justice issued a ruling ealier this year saying:-
    Article 3(1) of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC, must be interpreted as meaning that that directive is not applicable to a Union citizen who has never exercised his right of free movement, who has always resided in a Member State of which he is a national and who is also a national of another Member State.

    It is a little bit complicated by the fact that your husband previously worked in France.

    Personally I really don't have the knowledge to advise one way or the other.
    Unless any other members have a good understanding of the ruling then my best advice would be to have a consultation with an experienced immigration advisor.

    Certainly it's not sufficient just to be a dual national.

    Thanks micawber for the info. Though EEA will not cost so much to apply, there is still way for us to go for spousal, right? I will seek for more wider explanation of ECJ. We might consider to ask for an immigration advisor. anyway, maybe I can still consider any thoughts from other members here. I welcome any ideas. Thanks again.

    You don't need an advisor or agent to apply your visa. You only need to know if EEA family permit is a possible solution.
    I have a feeling it's not a route for you. But you just need to be sure. I think it's worth checking as the EEA family permit is not only free, it's also a right for EU citizens.

    thanks Micawber for the concern and infos. I will just be the one to apply for my visa. As what I've knew that this will just cost money if you hire an agency. Just like what u said, we will just make sure if this the possible route. Im still open to everybody who would like to suggest and voice out their opinions. Do you think we will just go for spousal?
