My Girlfriend of 6 months has overstayed by 2 years immigration are aware as the served her a sp form "liable person to be detained" we are in love and really want to continue our relationship. We are struggling to find out the best route forward, is it best for her to return to the Philippines and marry there to return or is there a way to help her stay in the UK and prove to immigration the relationship is real. appreciate any feedback on this
From what I've read, the UKVI view overstaying in a poor light and so should you elect for her to leave, then your subsequent application might be prejudiced because of that. She might be subject to a ban for example. I'm not sure that you have the option of marrying her in the UK and then submitting an application because she's already illegal.
