Help please!!

    My Girlfriend of 6 months has overstayed by 2 years immigration are aware as the served her a sp form "liable person to be detained" we are in love and really want to continue our relationship. We are struggling to find out the best route forward, is it best for her to return to the Philippines and marry there to return or is there a way to help her stay in the UK and prove to immigration the relationship is real. appreciate any feedback on this

    From what I've read, the UKVI view overstaying in a poor light and so should you elect for her to leave, then your subsequent application might be prejudiced because of that. She might be subject to a ban for example.

    I'm not sure that you have the option of marrying her in the UK and then submitting an application because she's already illegal. It looks like you're in a hard place and I'm sorry. I recommend that you seek professional advice.

    If you marry a UK citizen who has worked in the EU, then you can 'regularise' the immigration status. Again, I suggest that you talk to an immigration solicitor but I feel that you're going to have to jump through some serious hoops, either having her leave the country and possibly be subject to a ban, or you work in the EU (for example)...

    What do you do for a living Grant? If you could get work in any other European country for 3-5 months your Wife could stay you for free and then return to the UK for free no earnings of nhs suppliment and only a fee of around £90
