Help required re Citizenship

    My stepdaughter came to UK in April 2012 on a visa to join her mother in UK as she was under the age of 18.

    Her UK visa says Indefinite leave to enter UK

    My question is when can she apply for Citizenship?

    Have a look at this. These are the "newer" rules which came into force on 8th July 2012. Under the old rules it may well be less time as it is for those that have aquired Indefinite Leave to Remain.

    From the UKBA web site (link below):

    Standard requirements for naturalisation
    Residential requirements

    "To demonstrate the residential requirements for naturalisation, you must have:

    • been resident in the UK for at least five years (this is known as the residential qualifying period); and
    • been present in the UK five years before the date of your application; and
    • not spent more than 450 days outside the UK during the five-year period; and
    • not spent more than 90 days outside the UK in the last 12 months of the five-year period; and
    • not been in breach of the Immigration Rules at any stage during the five-year period."

    ECB9.6 Indefinite Leave to Enter (ILE) and Indefinite Leave to Remain (ILR)
    "Applicants who are granted Indefinite Leave to Enter (ILE) at a visa issuing Post should have no time restrictions on their stay in the UK, that is, they can stay indefinitely. ILE carries the same entitlement as 'Indefinite Leave to Remain' (ILR) which is issued by the UK Border Agency to those who have already travelled to the UK. Anyone who has ILE does not have to apply for ILR when in the UK."
