Guys/Gals, A friends wife is going to be applying for ILR (pre July 2012 spousal rules). When can she apply, is it 3 months before the visa comes to an end? Thanks
Quick answer is 28 days before the end of the 2 year period since date of arrival in the UK....rather than when the visa ends. Under the old rules, on a spouse visa, the qualifying period for ILR is 24 months living in UK You may apply 28 days before the end of the qualifying period.
I was going to ask you if she arrived on a spouse visa? If so then that would be the case. However, on a Fiancee visa it is slightly different. In our case, my wife arrived on a Spouse visa. And then we had to wait until she was inside the last 28 days of her 2 year period since the date she arrived. BTW Preferably well inside the 28 days, rather than "last minute".
