ILR query

    Guys/Gals,
    A friends wife is going to be applying for ILR (pre July 2012 spousal rules). When can she apply, is it 3 months before the visa comes to an end?

    Quick answer is 28 days before the end of the 2 year period since date of arrival in the UK....rather than when the visa ends.

    Under the old rules, on a spouse visa, the qualifying period for ILR is 24 months living in UK
    You may apply 28 days before the end of the qualifying period.

    I was going to ask you if she arrived on a spouse visa? If so then that would be the case. However, on a Fiancee visa it is slightly different.

    In our case, my wife arrived on a Spouse visa. And then we had to wait until she was inside the last 28 days of her 2 year period since the date she arrived.

    BTW Preferably well inside the 28 days, rather than "last minute".

    Yes, spousal. I've passed the details on to them. Will have to check the FLR rules for my asawa for when she applies. Some time to go yet anyhow
