@a8amg - Was the content of your application complex or straight forward? Would you be willing to share with us any complexities or issues that the Descision Making Centre are referring to?
i was referring to @a8amg post #20. if you recall--he had his wife's application approved---but her child's application...made at the same time--was refused. so he has applied again--more expense--stress--anxiety--and all for--what ? i'm sure a simple question or 2 from the case worker in the first instance would have sorted it. but then--ukvi are taking a hard line with dependant child applications.
Yes fully aware of the history. You referred to the UKBA turning the screw in their letter that was posted however I would suggest that they are merely advising on why there is a detail on dealing with said application. (Only the reciepient will know the fine detail of their application) Can you support your view with %ages of failures against successes in child applications or is it just your view?
only going on what ive read on here. with a child application...the vaf4 online form simply does not ask enough relevant questions....so how does the applicant ( in our case--me) guess what ukvi want to know. exactly the same happened with @a8amg. for instance--in the refusal--in BOTH cases--the sponsor was referred to as the mother--clearly not the case. it seems the only way to find out what ukvi want to know--is to budget for TWO applications--get refused the first time--then deal with the refusal reasons. whereas a simple enquiery from ukvi could solve the problem; but then why should they ? by refusing --on whatever reason--the application can go to appeal--a lengthy expensive process--and let the judge decide. just passing the buck, whilst helping to keep immigration figures down--for now.
So you have only a small sample that the view is based on. Para 2 in the rules it refers to parent or parents for settlement this I guess is how they arrive at the ( in your case) mother being the sponsor as she is legally responsible they then attach you to her for the finance sponsorship! Para 3 wouldn' stand up to scrutiny as a few people that work in government are finding out!
I know of two cases personally. In one case the couple overturned the decision in court. At greaaat expense to them. We are talking 5 figures. In their case the decision against the application was made erroneously.
What Bigmac is saying I believe, is that he has seen a lot of couples pass by on the forum over the course of time and has a feel for the numbers. Does anyone have any stats to say he is wrong?
As I suggested it is a view and everyone is entitled to views. Having been a member on here since 2014 not as long as some I know I have probably a similar feel to have a view. As for stats I have never found any, there are probably some. You may find them in the link I posted in this thread earlier.
