Leaving UK with her Citizenship

    Just thinking about any possibilities to hamper our exit from UK next month.
    My wife will have just received her UK citizenship certificate before we leave the UK next month,..she wont have time to apply for her UK passport but I've read that she can obtain that from over in the Philippines at the Embassy there.
    Question is,...can she legally use her Filipino passport ( in date) to leave the UK ?...even although she is now a UK citizen ?
    Will passport control here in the departing airport be able to identify her through her Filipino passport as now being British ?

    NO! she can't use her Philippine passport anymore, it was automatically cancelled the day she took an oath, she has to re-affirm her Filipino citizenship, if she wishes to use her Philippine passport again and she will then have dual nationality.

    I have called the Philippine Embassy about this because I wanted to travel using my Philippine passport, but I was told that I cannot use it anymore and Philippine Embassy in London confirmed that the day I took my oath, it becomes invalid, therefore I lose the right to use it.

    Apparently, the day I took an oath, the UKBA informs the Philippine Embassy that I am now a British Citizen. So my existing Philippine passport becomes invalid.

    edit: Sorry my advice below is wrong it only applies to passport renewals.

    All I could suggest is go make an express same day application at the passport office once your wife has her document, costs more but I would imagine that she should have no problem.

    Good point that was exactly the question going round in my head, how would the Philippine authorities know that she had taken the UK oath, but if they actually notify them well then that explains it.

    Jonny I hope your travel dates fit in with the same day application process, and remember that passport details are required by airlines for check-in and sometimes before, be careful not to provide details from your wife's Philippine passport to the airline early, as you probably won't be able to change that later.

    My wife will have to renew her Filipino passport in June next year. And then she will apply for citizenship in October - ish. We will have wasted money on her passport renewal. :erm: Oh well, if it has to be done....

    How do I apply for a British passport?

    This page contains information about applying for a British passport if your application for British nationality is successful.

    British passports are issued by the UK government's Her Majesty's Passport Office (HM Passport Office).

    All adult customers (aged 16 and over) applying for a passport for the first time must attend an interview with HM Passport Office in person to confirm their identity. HM Passport Office recommends you allow 6 weeks for your passport application to be processed. You should not make any travel arrangements until you receive your passport.

    Okay. That's good for us as the passport office here is within walking distance of where we live. Its the Philippine Embassy that is going to be a bit of a trek....

    JohnAsh, try to make an inquiry regarding this, I happen to know my Thailander friend had her ILR with her Thailand passport then it expires before her Citizenship. She then did not bother to renew it as her husband does not want to pay for her new passport. Her husband said she is not travelling any time soon so they let it expire and still uses it to apply for her Citizenship. Then she had her Citizenship based on her expired passport and the explanation to this is pretty logical, they had her old Thailand passport when they process her ILR.

    I see. You are saying that there would be no need to renew my wife's Philippine passport under such circumstances? She could apply for British citizenship using her expired Philippine passport?

    Yes, I will check up on this. Like I say, we have great access here to the Immigration department so I will give them a call.

    It would save us a trip to London. Though we could always make it a small holiday.

    What only matters to them is, that her old passport UK visa existed, as she is no longer using the same passport to travel with, because she intend to obtain passport from UK.

    Yeah. Also the hassle. We would all have to go down there, baby and all. It would mean a flight or a ferry journey.

    Where did i read last night ?...somewhere it states on the Philippines government sites that even though a former Citizen has taken an oath for citizenship of another country , that person can still be recognised as a Filipino citizen ??
    Did I read it correctly ? I will have to go search my browser history and see.

    Or,.... could she take her oath over in Philippines ??? ( we only have the confirmation that her application was successfull, she hasn't taken the oath yet ) It does say that you have 90 days to take your oath after you get your invitation (which is coming in the next 2 weeks )

    I believe that the oath can only be taken at the Embassy.

    This was from the Bureau of Immigration of The Philippines.......
    Republic Act No. 9225 otherwise known as the Citizenship Retention and Reacquisition Act of 2003 declares that natural-born citizens of the Philippines who become citizens of another country shall be deemed not to have lost their Philippine citizenship.


    Aromulus :...would that be the British Embassy in Manila you are suggesting ??
    Think I also read somewhere that if you take the oath there you can apply for your UK passport while there too ??

    Sometimes confusing for us mere mortals of hard-working manual labourers !

    The Philippines Embassies around the world... Where they will be able to process new passports for their citizens, wether old or re-aquired
