Minimum income threshold for family migrants - update

    So this basically means that my wife that will be applying on September will not get her Visa decision yet and will be put into hold?

    Not necessarly. What are your circumstances? Did you meet all of the requirements? And which visa?

    Im currently on a Tier 1 Post Study Working (PSW) visa which will end on July 2014. I am currently confused about the new law regarding the minimum income threshold. Does this affect the application of my wife for TIER 1 POST STUDY PARTNER VISA? Because my wife had done the application online, got all the other requirements including the maintenance balance for 90 days. So basically she is just waiting for the result of her PTB testing in Philippines which unfortunately got delayed because of the typhoon in manila, after that she will then apply for her visa. Everything else is in place then I read about this new law which gets me very anxious. Im sorry that I wrote a long message. Hope you could answer my questions.

    Thank you for sharing that link but I had read that already. I just would like to know if my wife's application as TIER 1 Post study partner visa is affected by the minimum income threshold.

    Many of us here are familiar with the spousal route for those whose husband or wife are settled in Britain / UK. The original post relates to that. Under such a visa application the sponsor should earn over £18600 per annum, if not then the application will be put on hold, as things stand.

    It doesn't sound like it would apply to the visa of a wife whose husband is on a visa such as yours. Though I am not completely certain and hopefully someone else might know the answer for sure.

    It does say:

    "Any dependants wishing to join the main applicant must also provide evidence that they have sufficient funds."

    And also :

    "This page explains what documentary proof dependants (spouses or civil partners, migrant's unmarried or same-sex partner or migrant's child) must provide of their available maintenance (funds) to support an application for leave to remain as the dependant of someone who is here under the post-study worker category (Tier 1 Post-study work) of the points-based system to work in the United Kingdom."

    I did notice that there is a requirement for the wife to apply at the same time as the husband though it doesn't give any indication what happens if that isn't the case.

    Completing the dependant application form
    "We encourage you to send dependant applications at the same time as the main application.

    Dependants should state if they are submitting their application at the same time as your application. This tells us that both applications should be considered together.
